SUBJECT: CONSIDERATION OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO AMEND A CONTRACT WITH BC LABORATORIES, INC. TO CONDUCT MONITORING ACTIVITIES IN SUPPORT OF TMDL DEVELOPMENT

DISCUSSION: SWRCB Contract Number 8-028-130-0 with BC Laboratories, Inc., supports laboratory needs for the Central Coast Regional Water Quality Control Board. This three-year contract is currently for a total of $200,000. Its term is from 7/1/98 to 6/30/2001.

Funds have become available through U.S. EPA Clean Water Act Section 104/106 to conduct monitoring activities related to development of Total Maximum Daily Load assessments on the Salinas watershed. In order to undertake this work, it is necessary that additional funds be available for laboratory expenditures. Funds are currently available from the FY 98/99 allotment, but additional funds are anticipated in FY 99/00.

This resolution would enable the contract to be amended at any time over the life of the contract for a total amount not to exceed $400,000 to allow these funds to be spent conducting TMDL related monitoring activities.

POLICY ISSUE: Should the SWRCB authorize the Executive Director or his designee to amend a contract with BC Laboratories, Inc. to increase the total amount?

FISCAL IMPACT: The Central Coast RWQCB will work to ensure that there is adequate reimbursement authority. The total amount of the contract will not exceed $400,000 over a three-year period.

RWQCB IMPACT: The Central Coast RWQCB will manage the contract and direct the work.

STAFF RECOMMENDATION: That the SWRCB authorize the Executive Director, or his designee, to amend the contract with BC Laboratories, Inc.

AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO AMEND A CONTRACT WITH BC LABORATORIES INC. FOR UP TO $400,000 IN TOTAL TO CONDUCT ANALYSIS FOR MONITORING ACTIVITIES IN SUPPORT OF TMDL DEVELOPMENT IN THE CENTRAL COAST REGION

WHEREAS:

1. The Central Coast Regional Water Quality Control Board is undertaking monitoring activities related to TMDL development in the Salinas watershed, and additional laboratory funding is required in order to accomplish those studies.

2. Funds are currently available from U.S. EPA CWA Section 104/106 to allocate towards this monitoring effort, and additional funds are anticipated in Fiscal Year 1999/2000.

3. The proposed contract amendment would enable those funds to be spent for analysis of water samples collected as part of the 104/106 grant.

4. The Contract would be amended up to a total amount of $400,000.

5. The Regional Board will continue to manage the contract with BC Laboratories through 6/30/2001.

THEREFORE BE IT RESOLVED THAT:

The SWRCB authorize the Executive Director or his designee to amend an existing contract with BC Laboratories, Inc. in an amount not to exceed $400,000.
