APPROVAL OF THE TRANSFER OF LIABLITY OF WATER QUALITY CONTROL

FUND LOAN FROM  THE NORTH MARIN COUNTY WATER DISTRICT TO THE

TOMALES VILLAGE COMMUNITY SERVICES DISTRICT

 

DISCUSSION

 

The State Water Resources Control Board on May 15, 1975, by Resolution No. 75-52,

authorized a loan of up to $189,000 with a 10-year moratorium on repayment of principal and interest, to the North Marin County Water District (NMCWD) on behalf of the Tomales Sewer Improvement District for the purpose of construction of wastewater treatment facilities.

 

A Water Quality Control Fund loan in the amount of $189,000 (loan 5-003-500) was executed

on June 30, 1976. Construction of the facilities was completed on September 10, 1979.

 

The first total service payment was due and payable on June 15, the tenth year following the year of the first disbursement of funds.

 

All payments are current and there are twelve remaining payments due under the loan contract with an outstanding loan balance of $173,329.

 

In November and December of 1998, representatives of the Tomales community successfully

petitioned the Marin County Local Agency Formation Commission and the Marin County Board

of Supervisors for de-annexation from NMCWD.  The Tomales Village Community Services District (TVCSD) was formed on November 23, 1998 to provide wastewater treatment service to the Tomales community.  Transfer of assets and liabilities related to wastewater treatment from

NMCWD to TVCSD occurred on October 14, 1999.

 

NMCWD and TVCSD each adopted a resolution providing for relinquishment of the loan contract

by NMCWD and acceptance of all the obligations under the loan contract by TVCSD. Both agencies have requested that the State Water Resources Control Board (SWRCB) transfer the Water Quality loan contract from NMCWD to TVCSD.  The Tomales community has provided sufficient funds to NMCWD in each prior year to make the annual payments to the SWRCB due under the loan contract.

THEREFORE BE IT RESOLVED THAT:

 

The State Water Resources Control Board approve the transfer of Water Quality Control Fund loan 5-003-500 from North Marin County Water District to Tomales Village Community Services District.
