Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Ten of Forty-one samples exceeded the US EPA National Recommended Criteria of 750 ug/l (acute) during wet weather conditions (assumed to be between October 1 and April 30) and two samples exceed the Recommended Criteria of 85 ug/l (chronic) during the dry weather conditions and this does exceed the allowable frequency listed in Table 3.1 of the Listing Policy. However, pursuant to Section 6.15 of the Listing Policy, one is to consider environmental factors that could affect the assessment of the data. There are several exceedances of the 750 ug/l criteria in the dataset. However, these exceedances occurred 20 years ago. The most current data (1990 and beyond), show some exceedances but these occurred in March 2004 during a time the watershed was heavily influenced by wildfires. Pursuant to Section 6.1.5.3, if the majority of the samples were collected on a single day or during a single short term natural event (wildfires) the data shall not be used as the primary data set supporting the listing decision. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
RWQCB Board Decision / Staff Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. In addition, the majority of the exceedances took place in March 2004 (considered to be wet weather conditions) during a time that was heavily influenced by the wildfires in the watershed. Grouping the data as a whole is an inappropriate way of assessing the data because the two standards that would apply in the dry season (chronic) is different from the standard that would apply in the wet season (acute). The chronic recommended criteria of 85 ug/l is not an appropriate criteria to use during the dry season because it was derived using toxicity information on only one species of fish and assuming a low hardness that is not representative to arid west conditions of Southern California.

RWQCB Board Decision / Staff Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded. The data shows total recoverable concentrations and when compared to the California Toxics Rule (CTR) there are several exceedances of the criteria enough to warrant listing of the water body. However, the data set was more appropriately evaluated using the site specific total to dissolved ratio translator that was developed by the Use Attainability Analyses done for the Santa Ana River (an effluent dominated stream). This ratio, which has been used extensively in NPDES permits that were approved by US EPA, is 2.6 for cadmium and was applied for the data set regardless of wet or dry seasonality. However, data collected during the wet season or during the months of October through April were compared to the acute criteria only and data collected during the dry season were compared to the chronic criteria only. When the translator is used, there are no exceedances of the CTR criteria.

Data Used to Assess Water Quality:	49 samples have been collected below Prado Dam over a period of 18 years starting with 1973. Four of these samples were counted for the assessment because these had the detection limit below the criteria and of these four none exceeded the CTR criteria for cadmium. Total to dissolved ratio of 2.6 was used in converting the results from total to dissolved and then the results were compared to the acute ctr criteria.

Environmental Conditions:	The criterion for cadmium in the CTR is hardness dependent and the hardness varies in the river, consequently, the standard for cadmium also varies. The samples were collected during the months of October through April and these are the months used to define the wet season so the criteria used to compare the results was the acute criteria.

This site is located just upstream of the Prado Ponds diversion.

Weight of Evidence:	This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Two (2) lines of evidence are available in the administrative record to assess this pollutant. Seven (7) of the samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Seven (7) of seventeen samples exceed the California Toxics Rule acute criteria and none exceed the chronic criteria and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
