RECOMMITMENT
AND EXCHANGE OF THE STATE REVOLVING FUND (SRF) LOAN COMMITMENT FOR THE
LOS OSOS/BAYWOOD PARK WASTEWATER PROJECT
FROM FEDERAL
FISCAL YEAR (FFY) 1998-99 AND FFY 1999-00 SRF REPAYMENT FUNDS TO FFY 2001-02
AND FFY 2002-03 SRF REPAYMENT FUNDS, SRF PROJECT NO. C-06-4014-110
WHEREAS:
1. The
State Water Resources Control Board adopted Resolution No. 97-108 on November
18, 1997, amending Resolution No. 96-4 by exchanging the SWRCB's commitment
from FFY 1997-98 SRF repayment funds to FFY 1998-99 and FFY 1999-00 SRF
repayment funds.
Resolution
No. 97-108 also included a "sunset date" of April 1, 1999, for commencement
of construction or the preliminary loan commitment would be withdrawn.
The "sunset date" was extended by the Division of Clean Water Programs
to July 1, 1999;
2. The Los Osos Communities Services District (District), approved in the November 1998 elections, was established in January 1999 and has assumed responsibility for construction the Los Osos/Baywood Park Wastewater project from San Luis Obispo County;
3. San Luis Obispo County submitted a request, dated February 1, 1999, to extend the funding and outlined reasons for not complying with sunset date set forth in SWRCB resolution No. 97-108; and
4. The District submitted a project schedule, which indicates planning will be complete by July 2000, design complete by July 2001, and construction complete by July 2003.
THEREFORE BE IT RESOLVED THAT:
The State Water Resources Control Board:
1. Amends Resolution 97-108 by exchanging the commitment for a SRF loan of $47 million for the Los Osos/Baywood Park Wastewater project from FFY 1998-99 and FFY 1999-00 SRF repayment funds to $22 million from FFY 2001-02 and $25 million from FFY 2002-03 SRF repayment funds, with a repayment period of 20 years and the first payment due one year after completion of construction;
2. Will withdraw this $47 million preliminary loan commitment if a complete facilities plan, as defined by the SRF policy, is not submitted by the Los Osos Communities Services District by September 1, 2000. The Division may approve up to a 90 day extension of this date for good cause; and
3. Will require the Los Osos Communities Services District's facilities plan to be acceptable to the Central Coast Regional Water Quality Control Board and also be subject to the standard technical review by the Division.
