ITEM 4: CONSIDERATION OF APPROVAL OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO APPLY FOR AND ACCEPT THE FEDERAL FISCAL YEAR (FFY) 1998 CLEAN WATER ACT SUPPLEMENTAL SECTION 106 GROUND WATER GRANT

DISCUSSION: The State Water Resources Control Board (SWRCB) administers the Federal Clean Water Act (CWA) Section 106 Pollution Control Program Grant, including the Supplemental Section 106 Ground Water Grant. Funding for the Supplemental Section 106 Ground Water Grant has been provided by the U.S Environmental Protection Agency (U.S. EPA) since FFY 1986.

U.S. EPA has indicated that for FFY 1998 the Ground Water Grant funding target is $510,000. In addition, carry-over grant funds from FFY 1997 are estimated to be approximately $490,000.

POLICY ISSUES: Should the SWRCB adopt a resolution authorizing the Executive Director or his designee to apply for and accept a CWA Supplemental Section 106 Ground Water Grant from U.S. EPA and to negotiate, execute, approve, and/or amend program activities, workplans, contracts, and agreements not exceeding the total grant amount?

FISCAL IMPACT: For Fiscal Year 1997-98, $692,518 in budgetary authority is allocated to SWRCB organizations for this program. The Division of Water Quality staff will work with Division of Administrative Services' Budget Office to secure the required budgetary authority through the fund verification process to augment the budget.

REGIONAL BOARD IMPACT: Unknown until U.S. EPA approves the workplan.

STAFF RECOMMENDATION: That the SWRCB authorize the Executive Director, or his designee, to:

1. Apply for and accept an FFY 1998 Supplemental Section 106 Ground Water Grant for an amount up to $1,000,000, including any carry-over FFY 1997 grant funds.

2. Negotiate, approve, and modify program activities, workplan, and grant applications not exceeding the total grant amount.

3. Negotiate, execute, and/or amend contracts and agreements in accordance with the workplan.

AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO APPLY FOR AND ACCEPT THE FEDERAL FISCAL YEAR (FFY) 1998 CLEAN WATER ACT SUPPLEMENTAL SECTION 106 GROUND WATER GRANT

WHEREAS:

1. The State Water Resources Control Board (SWRCB) administers the Federal Clean Water Act Section 106 grant including the Supplemental Section 106 Ground Water Grant in California.

2. The U.S. Environmental Protection Agency (U.S. EPA) has indicated that the Section 106 Ground Water Grant funding levels for California in Federal Fiscal Year (FFY) 1998 will be approximately $510,000. Carry-over grant funds from FFY 1997 are estimated to be $490,000.

3. A workplan is being developed consistent with U.S. EPA grant guidelines.

THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director, or his designee, to:

1. Apply for and accept the FFY 1998 Supplemental Section 106 Ground Water Grant for an amount up to $1,000,000.

2. Negotiate, approve, and modify program activities, workplan, and grant applications not exceeding the total grant amount.

3. Negotiate, execute, and/or amend contracts and agreements in accordance with the workplan.
