SUBJECT: CONSIDERATION OF APPROVAL OF AN AMENDMENT TO THE MANAGEMENT AGENCY AGREEMENT WITH THE DEPARTMENT OF PESTICIDE REGULATION

DISCUSSION: The State Water Resources Control Board (SWRCB) and the Department of Pesticide Regulation (DPR) entered into a Management Agency Agreement (MAA) on May 29, 1996 to ensure that pesticides registered in California are used in a manner that protects water quality and the beneficial uses of water while recognizing the need for pest control. A modification of the MAA has been agreed to and necessitates a minor amendment by the SWRCB and DPR. The amendment is shown as a "strike-out" to the attached section of the MAA--VIII. "Dispute and Conflict Resolution Procedures-B. Formal Procedures" (Attachment).

POLICY ISSUE: Should the SWRCB approve a minor amendment to the MAA?

FISCAL IMPACT: None: Fiscal impacts from the modification are not expected.

RWQCB IMPACT:None

STAFF RECOMMENDATION: That the SWRCB:

  1. Approve a minor amendment to the MAA, and
  2. Direct the Executive Director to sign the amended MAA on behalf of the SWRCB.

RESOLUTION NO. 97-

AMENDMENT TO THE MANAGEMENT AGENCY AGREEMENT

WITH THE DEPARTMENT OF PESTICIDE REGULATION

 

WHEREAS:

  1. The Department of Pesticide Regulation (DPR) and the State Water Resources Control Board (SWRCB) entered into a Management Agency Agreement (MAA) on May 29, 1996.
  2. A minor modification of the MAA (Attachment 1) was agreed to by DPR and SWRCB staff that necessitates approval by the SWRCB.

 

THEREFORE BE IT RESOLVED THAT:

The SWRCB:

  1. Finds that approval of the amended MAA is exempt from the provisions of California Environmental Quality Act because it is part of the SWRCB's general policy and procedure making.
  2. Approves the amendment to the MAA.
  3. Directs the Executive Director to sign the MAA on behalf of the SWRCB.
  4. Finds that the amended MAA replaces the existing MAA, dated May 29, 1996.
  5. Finds that the amended MAA is consistent with the State's Nonpoint Source Management Plan.
