SUBJECT: CONSIDERATION OF APPROVAL TO AUTHORIZE THE EXECUTIVE DIRECTOR TO AMEND THE AGREEMENT WITH THE UNITED STATES ARMY CORPS OF ENGINEERS TO ADD $54,000 FOR STAFF TECHNICAL ASSISTANCE TO SUPPORT CONSTRUCTION OF THE TIJUANA INTERNATIONAL TREATMENT PLANT AND DELEGATE AUTHORITY TO THE EXECUTIVE DIRECTOR TO APPROVE ALL FUTURE AMENDMENTS RELATING TO THE COOPERATIVE AGREEMENT


DISCUSSION: - Resolution 96-84 authorized the Executive

Director to amend Cooperative Agreement3-902-550-3, November 27, 1996 with the United States Army Corps of Engineers (USCOE) which provided $934,000 to the State Water Board for staff technical assistance to support construction of the Tijuana International Treatment Plant.


In addition to State Water Board assigned tasks, the USCOE requests additional assistance for tasks associated with inspections, report review, and attendance at meetings relating to South Bay Ocean Outfall which will assist in the monitoring, permitting, and completion of the International Wastewater Treatment Plant. We will increase the cooperative agreement by $54,000 to fund these additional tasks.

Also, it is anticipated that there may be some additional tasks added to the project and funded by the USCOE. We are requesting that the State Water Board delegate authority to approve any future amendments relating to this cooperative agreement to the Executive Director.


POLICY ISSUE: Should the State Water Board authorize the Executive Director to amend the Interagency Agreement with the USCOE for the purpose of adding additional funds of $54,000 for staff technical assistance on construction of the Tijuana International Treatment Plant and authorization to approve future amendments relating to the cooperative agreement?


FISCAL IMPACT: The additional funds are not currently budgeted. Acceptance of the additional $54,000 would require approval from the Department of Finance to augment the State Water Board's FY 1996-97 and FY 1997-98 budget.

REGIONAL BOARD IMPACT: None


STAFF RECOMMENDATION: That the State Water Board authorize the

- Executive Director to amend the USCOE cooperative agreement to add $54,000 for staff technical assistance on construction of the Tijuana International Treatment Plant and delegate authority to approve all future amendments relating to the cooperative agreement.

CONSIDERATION OF APPROVAL TO AUTHORIZE THE EXECUTIVE DIRECTOR TO AMEND THE AGREEMENT WITH THE UNITED STATES ARMY CORPS OF ENGINEERS TO ADD $54,000 FOR STAFF TECHNICAL ASSISTANCE TO SUPPORT CONSTRUCTION OF THE TIJUANA INTERNATIONAL TREATMENT PLANT AND DELEGATE AUTHORITY TO THE EXECUTIVE DIRECTOR TO APPROVE ALL FUTURE AMENDMENTS RELATING TO THE COOPERATIVE AGREEMENT



WHEREAS:


1. Interagency Agreement 3-902-550-3 dated November 27, 1996 with the United States Army Corps of Engineers provides $934,000 to the State Water Board and the San Diego Regional Water Quality Control Board for staff technical assistance to support construction of the Tijuana International Treatment Plant;


2. The United States Army Corps of Engineers has requested additional staff technical assistance related to the construction of the South Bay Ocean Outfall;


3. The amendment to the cooperative agreement with the United States Army Corps of Engineers will add $54,000 for staff technical assistance over a two year period.


4. Approval of this item will also delegate authority to the Executive Director to approve all future amendments to the cooperative agreement.


THEREFORE BE IT RESOLVED THAT:


The State Water Board hereby authorizes the Executive Director to amend an agreement with the United States Army Corps of Engineers, to add $54,000 for staff technical assistance to support construction of the Tijuana International Treatment Plant and approve all future amendments relating to the cooperative agreement.
