ITEM 9: CONSIDERATION OF TWO PROPOSED RESOLUTIONS, THE FIRST AUTHORIZING AN INTERAGENCY AGREEMENT BETWEEN THE DEPARTMENT OF WATER RESOURCES (DWR) AND THE STATE WATER RESOURCES CONTROL BOARD (SWRCB) TO MAKE IMPROVEMENTS TO THE DWR'S PLANNING MODEL AND THE SECOND AUTHORIZING THE APPROVAL OF AN EXTENSION OF AN INTERAGENCY AGREEMENT BETWEEN THE DWR AND THE SWRCB FOR STAFF SERVICES TO ASSIST IN THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT

DISCUSSION: The DWR seeks to enter into an interagency agreement with the SWRCB for up to $300,000 for the purpose of partially funding improvements to the DWR's planning models. These improvements will benefit the SWRCB in future water quality planning and water right actions.

Under the proposed interagency agreement, the DWR will modify the hydrology development currently used for the San Joaquin River system in its planning model process. The present hydrology development process is based on entitlements. The new process will be based on land use demands, as is presently the case for the Sacramento River system. The DWR will also incorporate a water rights data base into its planning model to determine water availability under different operational conditions.

In addition, SWRCB staff seeks to extend an existing interagency agreement with the DWR for two staff members to assist in the preparation of the SWRCB's environmental impact report for implementation of the 1995 Water Quality Control Plan for the Bay/Delta. The staff are assigned to the Division of Water Rights and are supervised by SWRCB supervisory staff. The existing interagency agreement, which expires on September 30, 1997, would be extended to June 30, 1998, and the amount under the contract would be increased from $183,659 to $310,000.

The SWRCB received $350,000 for fiscal year 1996-97 from the Renewable Resources Investment Fund for the purpose of contracting for services to assist in the SWRCB action to implement the 1995 Water Quality Control Plan for the Bay/Delta. The SWRCB anticipates approval of a Budget Change Proposal for an additional $350,000 from the same source for FY 1997-98. Both the proposed extension of the existing interagency agreement for staff service and the proposed interagency agreement for modeling improvements will be funded from this source. The remaining funds ($90,000) are being used to hire students to assist in Bay/Delta-related activities in the Division of Water Rights.

POLICY ISSUE: Should the SWRCB authorize the Executive Director to execute the proposed interagency agreements with the DWR to make modeling improvements and to extend the existing interagency agreement for staff services?

FISCAL IMPACT: This activity is budgeted within existing resources and no additional fiscal demands will occur as a result of approving this item.

REGIONAL BOARD IMPACT: None

STAFF RECOMMENDATION: Staff recommends adoption of the two proposed resolutions.

AUTHORIZING APPROVAL OF AN INTERAGENCY AGREEMENT BETWEEN THE DEPARTMENT OF WATER RESOURCES (DWR) AND THE STATE WATER RESOURCES CONTROL BOARD (SWRCB) TO MAKE IMPROVEMENTS TO THE DWR'S PLANNING MODEL

WHEREAS:

1. The SWRCB has funding available from the Renewable Resources Investment Fund for the purpose of contracting for services to assist the SWRCB in its action to implement the 1995 Water Quality Control Plan for the San Francisco Bay/Sacramento San Joaquin Delta Estuary.

2. The DWR conducts planning studies to determine the effects of operational and regulatory changes on the State Water Project and the Central Valley Project;

3. The DWR intends to make improvements to the modeling process to increase the efficiency and flexibility of the model;

4. The proposed modeling enhancements will benefit the SWRCB in its environmental review and decision making process;

THEREFORE BE IT RESOLVED:

That the SWRCB authorizes the Executive Director to execute an interagency agreement with the DWR for $300,000 to make improvements to the DWR's planning model.

AUTHORIZING APPROVAL OF AN EXTENSION OF AN INTERAGENCY AGREEMENT BETWEEN THE DEPARTMENT OF WATER RESOURCES (DWR)AND THE STATE WATER RESOURCES CONTROL BOARD (SWRCB) FOR STAFF SERVICES TO ASSIST IN THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT (EIR)

WHEREAS:

1. The SWRCB has funding available from the Renewable Resources Investment Fund for the purpose of contracting for services to assist the SWRCB in its action to implement the 1995 Water Quality Control Plan for the San Francisco Bay/Sacramento San Joaquin Delta Estuary (1995 WQCP).

2. The SWRCB and the DWR currently have an interagency agreement (SWRCB No. 6-029-300-0) for staff services. The staff provided are assisting the SWRCB in the preparation of an EIR for the 1995 WQCP. The interagency agreement expires on September 30, 1997.

THEREFORE BE IT RESOLVED:

That the SWRCB authorizes the Executive Director to extend the existing interagency agreement with the DWR for staff servies through June 30, 1998 and to increase the maximum amount to be encumbered under the agreement from $183,659 to $310,000,
