ITEM 2: AMENDMENTS TO THE POLICY FOR IMPLEMENTING THE STATE REVOLVING FUND FOR CONSTRUCTION OF WASTEWATER TREATMENT FACILITIES (SRF POLICY), TO ALLOW FUNDING OF DESIGN BUILD PROJECTS

DISCUSSION: The SRF Policy is the document used by the Division of Clean Water Programs (Division) to administer the State Revolving Fund (SRF) Loan Program. Monies in this fund may be used to provide financial assistance for the construction of waste-water treatment and water reclamation facilities, correction of nonpoint source and stormwater drainage pollution problems, and for estuary enhancement activities.

The Division is seeing a greater interest in Design-Build projects from both the public agencies and the consulting engineers. Design-Build is a relatively new method of delivering construction projects and is growing in popularity. However, the current SRF guidelines are not comprehensive enough to properly implement the Design-Build method, and also do not address the design review and approval procedures adequately.

The Division, therefore, asked for input from Tri-TAC on draft amendments to these guidelines to provide for SRF funding of Design-Build projects. After a series of meetings, the Tri-TAC has indicated that the proposed amendments are acceptable. A copy of Tri-TAC's letter on the proposed amendments is attached (Exhibit A-1).

In order to provide for SRF funding of Design-Build projects, the Division proposes amendments to the current policy. Exhibit A-2 shows the proposed language changes.

POLICY ISSUE: Should the proposed amendments to the SRF Policy to provide for funding for Design-Build projects be adopted?

FISCAL IMPACT: The staff effort to administer the SRF is provided from the SRF Capitalization Grant (up to four percent of each Capitalization Grant can be used for administration). Staffing levels approved for the Division for state fiscal year 1997-98 will be sufficient to administer the program including any increased workload resulting from the proposed amendments.

RWQCB IMPACT: No impact.

STAFF RECOMMENDATION: That the SWRCB adopt the proposed amendments to the SRF Policy as shown in Exhibit A-2.

RESOLUTION NO. 97 -

ADOPTION OF AMENDMENTS TO THE POLICY FOR IMPLEMENTING THE STATE REVOLVING FUND FOR CONSTRUCTION OF WASTEWATER TREATMENT FACILITIES (SRF POLICY) TO ALLOW FUNDING OF DESIGN-BUILD PROJECTS.

WHEREAS:

1. The SRF Policy is the document used by the Division of Clean Water Programs (Division) to administer the State Revolving Fund (SRF) Loan Program;

2. Because of rapid growth in popularity for the Design-Build approach, a greater interest in Design-Build projects from both the public agencies and the consulting engineers has been noticed;

3. As a result of this interest, the Division was asked to prepare the proposed revisions to the current SRF Policy to provide for SRF loan funding for Design-Build projects; and

4. The Design-Build project submittal review and approval requirements and procedures have been developed by the Division after several meetings and discussions with the Tri-TAC members and Design-Build consultants.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board adopts the SRF Policy as amended, to provide SRF loan funding for Design-Build projects.
