SUBJECT: CONSIDERATION OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO NEGOTIATE, APPROVE, AND AMEND IF NECESSARY AN INTERAGENCY AGREEMENT WITH THE UNIVERSITY OF CALIFORNIA TO CONDUCT TOXICITY STUDIES IN SUPPORT OF THE CALFED BAY-DELTA PROGRAM
DISCUSSION: Earlier this year, the SWRCB passed Resolution No. 98-098. This Resolution authorized two interagency agreements to accept Proposition 204 funds ($900,000) to support toxicity studies in the Sacramento River watershed and the Delta. The interagency agreements provided CALFED funding for CVRWQCB staff to carry out studies to determine the significance of unknown toxicity.
CALFED had requested that the Regional Board be responsible for managing the toxicity studies. The toxicity testing portion of the study would be contracted to the University of California. The total amount of the contract will not exceed $600,000. The project period will be three years.
POLICY ISSUE: Should the SWRCB authorize the Executive Director or his designee to support the CALFED Bay-Delta Program and negotiate, approve, and/or amend an interagency agreement with the University of California?
FISCAL IMPACT: The Central Valley RWQCB and the Budget Office will work to ensure that there is adequate reimbursement authority. The total amount of the contract will not exceed $600,000 over a three-year period.
RWQCB IMPACT: Yes, the Central Valley RWQCB will be managing the contract and directing the work.
STAFF RECOMMENDATION: That the SWRCB authorize the Executive Director, or his designee, to negotiate, execute, and/or amend an interagency agreement with the University of California.

RESOLUTION NO. 99-
AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO NEGOTIATE, EXECUTE,
AND AMEND IF NECESSARY AN INTERAGENCY AGREEMENT WITH THE UNIVERSITY OF
CALIFORNIA IN THE AMOUNT OF $600,000 TO CONDUCT TOXICITY STUDIES IN SUPPORT
OF THE CALFED BAY-DELTA PROGRAM
WHEREAS:
1. The CALFED Bay Delta Program has indicated that it proposes an interagency agreement with the State Water Resources Control Board for the sum of $900,000 to support toxicity studies in the Sacramento River watershed and the Delta.
2. The proposed agreement would use a portion of those funds ($600,000) to subcontract with the University of California to conduct toxicity studies.
3. The Regional Board would manage an interagency agreement with the University of California for $600,000 for three years.
THEREFORE BE IT RESOLVED THAT:
The SWRCB authorizes the Executive Director or his designee to negotiate, approve, and/or amend an interagency agreement with the University of California.
