ITEM 6:  APPROVING THE USE OF EMERGENCY, ABANDONED, RECALCITRANT (EAR) ACCOUNT FUNDS UP TO $200,000.00 FOR THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, LAHONTAN REGION, TO CONTINUE TO CLEAN UP PETROLEUM CONTAMINATION FROM THE LEAKING UNDERGROUND TANKS LOCATED AT 3208 HIGHWAY 50 IN MEYERS, EL DORADO COUNTY

DISCUSSION:  Petroleum from the underground storage tank system at the Beacon Gas Station at 3208 Highway 50 in Meyers, El Dorado County, has polluted the ground water beneath and in the vicinity of the site and has impacted the South Tahoe Public Utility District’s Arrowhead Nos. 1 and 2 municipal drinking water supply wells.

The J. E. Tveten Corporation has failed to take corrective actions ordered by the Regional Board in Cleanup and Abatement Order No. 6-98-18. Significant amounts of petroleum remain in soil and ground water at the site and are a continuing threat to human health, safety, and the environment.

At the Regional Board’s request, on July 14, 1998, the Chief of the Division of Clean Water Programs approved $100,000 in emergency funding. Later the SWRCB authorized $200,000.00 prompt action funding from the EAR Account for implementation and ongoing remediation of a ground water pump and treat system at the site to remediate the petroleum pollution. Adoption of the proposed resolution is required in order to allow the Regional Board to continue the remediation effort with an additional $200,000.

POLICY ISSUE:  Should the SWRCB adopt a resolution authorizing expenditure of EAR funds for cleanup of petroleum pollution from leaking underground storage tanks located at 3208 Highway 50 in Meyers.

RWQCB IMPACT:  The remediation will be administered by the Lahontan Regional Board.

FISCAL IMPACT:  The EAR Account will be reduced by $200,000.

STAFF RECOMMENDATION:  That the SWRCB adopt a resolution approving expenditure of EAR Account funds in the amount of $200,000.

APPROVAL OF A REQUEST TO USE UP TO $200,000 FROM THE EMERGENCY, ABANDONED, RECALCITRANT (EAR) ACCOUNT AT THE BEACON GAS STATION SITE LOCATED AT 3208 HIGHWAY 50 IN MEYERS, EL DORADO COUNTY

WHEREAS:

1. The Executive Officer of the California Regional Water Quality Control Board, Lahontan Region, submitted a written request to the Chief of the Division of Clean Water Programs for funding in an amount not to exceed $200,000 from the EAR Account for the prompt cleanup of petroleum from the underground storage tank (UST) system at the Beacon Gas Station at 3208 Highway 50 in Meyers, El Dorado County, which has polluted the ground water beneath and in the vicinity of the site and has impacted the South Tahoe Public Utility District’s Arrowhead Nos. 1 and 2 municipal drinking water supply wells;

2. Prompt action by the California Regional Water Quality Control Board to abate the situation is necessary to protect human health and the environment;

3. Funds are available from the EAR Account, established pursuant to section 25299.50 of the Health and Safety Code (Underground Storage Tank Cleanup Fund Program);

4. The California Regional Water Quality Control Board issued Cleanup and Abatement Order No. 6-98-18 on March 19, 1998 and the J. E. Tveten Corporation has failed to take corrective actions as ordered; and

5. Section 25299.51 of the Health and Safety Code authorizes the State Water Resources Control Board to provide funds to California Regional Water Quality Control Boards for cleanup of UST sites.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board pursuant to section 25299.50 of the Health and Safety Code, authorizes an amount not to exceed $200,000.00 from the EAR Account for the Lahontan Regional Board to perform prompt corrective action at 3208 Highway 50 in Meyers.
