APPLICATION AND ACCEPTANCE
DISCUSSION
Federal
regulations (40 CFR 35.3150) require the State to submit an annual IUP
to the U.S. Environmental Protection Agency (EPA).The
Division of Clean Water Programs (Division) has prepared a proposed SFY
1999/2000 IUP consistent with federal rules which describes the intended
uses of State Revolving Fund (SRF) monies for SFY 1999/2000.A
copy of the SFY 1999/2000 IUP based on a California share of FFY 2000 federal
appropriation of $96,314,427 is contained in Exhibit A.
The
Division proposes that the Executive Director be authorized to apply for
and accept the FFY 2000 Capitalization Grant in the amount of about $96,314,427.
The
federal appropriation requires a 20 percent state match. The
match money ($19,262,885) for the FFY 2000 Capitalization Grant will be
provided from by any uncommitted funds remaining in the Safe, Clean, Reliable
Water Supply Act passed by the voters on November 5, 1996, by the local
match contribution from local agencies participating in the local match
program, by transfer of any unobligated funds from the Water Quality Control
Fund, or from match monies made available should Proposition 13 pass on
March 7, 2000.

Should
the State Water Resources Control Board (SWRCB); 1) approve the SFY 1999/2000
IUP; and 2) authorize the Executive Director to apply for and accept the
FFY 2000 SRF Capitalization Grant
FISCAL
IMPACT
The
State match of $19,262,885 for the FFY 2000 Capitalization Grant will be
provided from the $23.5 million in general obligation bonds made available
by Proposition 13, if it passes on March 7, 2000.If
Proposition 13 fails, the match will be provided from a combination of
unencumbered funds from previous bond issues, the Water Quality Control
Fund, and/or by using monies made available by the local match program.

That
the SWRCB adopt a resolution approving the SFY 1999/2000 IUP and authorize
the Executive Director to apply for and accept the FFY 2000 SRF Capitalization
Grant.

WHEREAS:
1.The
Division of Clean Water Programs has prepared a draft SFY 1999/2000 IUP
in compliance with federal rules, and such plan must be submitted to the
United States Environmental Protection Agency annually;
2.Congress
has appropriated FFY 2000 State Revolving Fund monies with California's
share being $96,314,427 and the State Water Resources Control Board will
make application for the funds;
3.The
state match totaling $19,262,885 will be available if Proposition 13 passes
or it can be provided from remaining unencumbered funds in previous bond
issues, the Water Quality Control Fund, and/or from the local match program;
4.Authorization
to accept the FFY 2000 SRF Capitalization Grant award is needed.
THEREFORE
BE IT RESOLVED THAT:
The
State Water Resources Control Board:
1.Approves
the SFY 1999/2000 IUP;
2.Authorizes
the Executive Director to apply for and accept the FFY 2000 SRF Capitalization
Grant.
