SUBJECT
CLEAN WATER STATE REVOLVING FUND STATE FISCAL
YEAR (SFY) 1999/2000 INTENDED USE PLAN (IUP) AND FEDERAL FISCAL YEAR (FFY) 2000
FEDERAL CAPITALIZATION GRANT AND TITLE II FUND TRANSFER APPLICATION AND
ACCEPTANCE
DISCUSSION
Federal regulations (40 CFR 35.3150) require the
State to submit an annual IUP to the U.S. Environmental Protection Agency
(EPA). The Division of Clean Water Programs
(Division) has prepared a proposed SFY 1999/2000 IUP consistent with federal
rules which describes the intended uses of State Revolving Fund (SRF) monies
for SFY 1999/2000. A copy of the
SFY 1999/2000 IUP based on a California share of
FFY 2000 federal appropriation of about $95,982,227 is contained in Exhibit A.
The Division proposes that the Executive
Director be authorized to apply for and accept the FFY 2000 Capitalization
Grant in the amount of about $95,982,227 and any Title II transfer monies that
may become available during the fiscal year.
The federal appropriation requires a 20 percent
state match. The match money of about
$19,196,445 for the FFY 2000 Capitalization Grant and any future Title II
transfer match needs will be provided from by any uncommitted funds remaining
in the Safe, Clean, Reliable Water Supply Act passed by the voters on November
5, 1996, by the local match contribution from local agencies participating in
the local match program, by transfer of any unobligated funds from the Water
Quality Control Fund, or from match monies made available should Proposition 13
pass on March 7, 2000.
POLICY
ISSUES
Should the State Water Resources Control Board
(SWRCB); 1) approve the SFY 1999/2000 IUP; and 2) authorize the Executive Director
to apply for and accept the FFY 2000 SRF Capitalization Grant and any available
future Title II funds?
FISCAL
IMPACT
The State match of about $19,196,445 for the FFY
2000 Capitalization Grant and any additional match needed for any Title II
transfers will be provided from the $23.5 million in general obligation bonds
made available by Proposition 13, if it passes on March 7, 2000. If Proposition 13 fails, the match will be
provided from a combination of unencumbered funds from previous bond issues,
the Water Quality Control Fund, and/or by using monies made available by the
local match program.
RWQCB
IMPACT
None.
STAFF
RECOMMENDATION
That the SWRCB adopt a resolution approving the SFY
1999/2000 IUP and authorize the Executive Director to apply for and accept the
FFY 2000 SRF Capitalization Grant and any future transferred Title II funds.
