Regional Board Staff Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Four lines of evidence are available in the administrative record to assess pollutant, two that assess fish tissue samples from tropic level 4 fish for COMM and two that assesses fish tissue samples for WILD, one from prey fish (50-150 mm length) collected between Feb.-July (LOE # 132972) and one from data collected during a previous cycle. A new mercury objective was recently adopted so fish tissue data from previous integrated report cycles was reassessed with the new objective to create updated lines of evidence. LOE # 46550 and LOE # 47542 were replaced by LOE # 132851 for COMM and LOE # 133060 for WILD. Two of two samples exceed the COMM tissue objective and three of three samples exceed the WILD tissue objective for mercury.

In 2014 the Office of Environmental Heath Hazard Assessment (OEHHA) published a health advisory for Little Rock Reservoir. The advisory provides information regarding which fish should not be eaten because of mercury contamination in the waterbody. For more information please see the OEHHA website.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of two samples exceed the COMM tissue objective and three of three samples exceed the WILD tissue objective and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

All fish collected between February and July of the same calendar year with a reported length of 50-150 mm were averaged into a single sample, independent or species of trophic level, for comparison with the objective. This LOE consists of a total of 32 fish, which were aggregated into 2 annual averages, consisting of 3 fish species (12 composite(s) of Green Sunfish each composed of 1 fish per composite, 10 composite(s) of Bluegill each composed of 1 fish per composite, 10 composite(s) of Largemouth Bass each composed of 1 fish per composite). Data Used to Assess Water Quality: Water Board staff assessed SWAMP data for Littlerock Reservoir to determine beneficial use support and results are as follows: 1 of 1 samples exceed the criterion for Mercury. Ten composites (1 fish per composite) were generated from one species (largemouth bass) and were averaged. The averaged composites for largemouth bass exceeded the guideline. Three composites (largemouth bass -1; common carp - 2) could not be used in the assessment due to total fish lengths that did not fall within lengths noted in the guideline. The results of the composites collected on the same day were averaged, per USEPA 2001, resulting in a total of 1 sample and 1 exceedance. Details of the compositing protocol can be found in the March 2009 report entitled: "Contaminants in Fish from California Lakes and Reservoirs: Technical Report on Year One of a Two-Year Screening Study" (SWAMP, 2009).

The number of sample locations per waterbody was based on the overall size of the waterbody (SWAMP, 2010). Additionally, OEHHA issued a fish consumption advisory for Littlerock Reservoir that supported a listing for Littlerock Reservoir during the 2010 listing cycle. 0 of 4 samples exceed the objective for the COLD beneficial use; 0 of 3 samples exceed the objective for the WARM beneficial use; 3 of 4 samples exceed the objective for the COMM beneficial use.

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 3 of 4 samples exceed the objective for the COMM beneficial use and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. A total of 8 samples for nitrate plus nitrite as N (1 to 3 per day) were taken. Section 6.1.5.6 of the Listing Policy directs that data collected at a single location on the same day should be combined and represented by a single resultant value. Five of the eight samples (collected on three dates) were below the detection level. The average nitrate plus nitrite concentration in three samples collected on 3/20/2003 was 0.186 mg/L. Data Used to Assess Water Quality: The USGS sampled Littlerock Reservoir under the Region 6 SWAMP program on four dates between 2001 and 2003. A total of 8 samples for nitrate plus nitrite as N (1 to 3 per day) were taken. Section 6.1.5.6 of the Listing Policy directs that data collected at a single location on the same day should be combined and represented by a single resultant value. Five of the eight samples (collected on three dates) were below the detection level. The average nitrate plus nitrite concentration in three samples collected on 3/20/2003 was 0.186 mg/L (as N). Samples for nitrite were collected concurrently with the nitrate plus nitrite samples. Five of the eight samples (collected on three dates) were below the detection level. The average nitrite concentration in three samples collected on 3/20/2003 was 0.005 mg/L. After subtracting the nitrite value from the nitrate value, the average nitrate concentration in the 3/20/03 sample was 0.181 mg/L as N. This is equivalent to 0.801 mg/L as nitrate, which (as the annual average datapoint for 2003) is in violation of the objective.

State Board Review and Conclusion:

The April 19, 2010 State Water Board staff report for the 2010 Integrated Report
recommended to place this water body on the 303(d) list for manganese based on the State Water Board staff determination that the data were collected over a broad period of time to meet section 6.1.5.3 of the Listing Policy.

The State Water Board recommendation is based on the following:

Lahontan Regional Board staff had decided not to list this water body because staff thought it had insufficient information to make a decision to list. However, State Board staff finds there are 4 samples to make a decision and this meets the sample size requirements of Table 3.1 of the Listing Policy.

On August 4, 2010 the State Water Board approved the staff recommendation to place this water body-pollutant combination on the 303(d) list.

State Water Board Review and Conclusion:

The April 19, 2010 State Water Board staff report for the 2010 Integrated Report recommended to place this water body on the 303(d) list for boron based on the State Water Board staff determination that the data were collected over a broad period of time to meet section 6.1.5.3 of the Listing Policy.

At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination. Based on this reevaluation, State Water Board staff recommended the listing recommendation be revised to not place this water body-pollutant combination on the 303(d) list based on the minimum numbers of samples showing exceedence of the water quality objective.

On August 4, 2010 the State Water Board approved the staff recommendation to not place this water body-pollutant combination on the 303(d) list. The final language for the recommendation is the same as written under the "Regional Board Conclusion" above.

Depth profiles of specific conductance, including a total of 42 separate measurements, were taken in the field. Section 6.1.5.6 of the Listing Policy directs that data collected at a single location on the same day should be combined and represented by a single resultant value. Average specific conductance on each of the the four sampling dates was as follows: (10/28/2001) 606 uS/cm; (5/7/2002) 601 uS/cm; (10/24/2002) 482 uS/cm; and (3/20/2003) 191 uS/cm . The MCL was not exceeded.

This assessment is based on the field data summarized above. Eight additional laboratory measurements of specific conductance were taken in samples collected on the same dates as the field samples. The Lahontan Basin Plan's narrative temperature objective is an antidegradation-based objective that requires that there be no change in temperature in waters designated for the Cold Freshwater Habitat (COLD) beneficial use. The objective does not include specific numerical limits for protection of the COLD use. Listing Policy Section 3.10 contains directions for assessment based on trends in water quality. These directions include requirements to establish specific baseline conditions and specify the influence of seasonal and interannual effects.

One line of evidence is available to support this decision. There are not enough temperature samples to establish baseline conditions (including diel, seasonal, annual and interannual variations in temperature) or to detect declining trends in the temperature regime if such trends exist.

Because temperature samples were collected only once or twice a year, weekly and monthly average data are not available for comparison with guidelines in the scientific literature for the temperature requirements of sensitive aquatic species such as salmonids, as directed in Listing Policy Section 6.1.5.9.

Data Used to Assess Water Quality: The U. S. Geological Survey took depth profile measurements of temperature in Littlerock Reservoir on four dates in 2001, 2002 and 2003. In 42 measurements, temperatures ranged from 8 to 17.5 degrees Celsius. The listing policy directs that multiple samples collected on the same date in the same location should be combined and represented by single value. Average temperatures in the depth profiles for the four sampling dates were 14. 7, 14.9, 15.2 and 8.9 degrees Celsius. (The reservoir was stratified on two dates and mixed on two dates.)

Sampling frequency was inadequate to characterize the natural temperature regime, including diel, seasonal and annual variation, or to detect whether changes in violation of the objective occurred.

Two lines of evidence, one each to evaluate the COLD and COMM beneficial uses, are available in the administrative record to assess this pollutant. None of the two samples exceeded the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:

The Lahontan Basin Plan's narrative pH objective is an antidegradation-based objective that requires that there be no change greater than 0.5 pH units in waters designated for the Cold Freshwater Habitat (COLD) or Warm Freshwater Habitat beneficial uses. A pH range of 6.5 to 8.5 units applies to "all other waters". Listing Policy Section 3.10 contains directions for assessment based on trends in water quality. These directions include requirements to establish specific baseline conditions and specify the influence of seasonal and interannual effects.

One line of evidence is available to support this decision. There are not enough pH samples to establish baseline conditions (including diel, seasonal, annual and interannual variations) or to detect changes in the pH regime due to controllable factors, if such trends exist.

Depth profiles of pH, including a total of 42 separate field measurements, were taken. Section 6.1.5.6 of the Listing Policy directs that data collected at a single location on the same day should be combined and represented by a single resultant value. For pH, this should be the maximum and minimum values. The ranges of pH on the four sampling dates were as follows: (10/28/2001) 7.2 to 7.4 units; (5/7/2002) 7.5 to 8.4 units; (10/24/2002) 8.2 to 8.4 units; and
(3/20/2003) 7.1 to 7.7 units. Eight laboratory measurements of pH were taken for samples collected on the same dates as the field measurements. One of these samples was an estimate. After combining data collected on the same day, the four laboratory values ranged from 7.2 to 8.0 units. Sampling frequency was inadequate to document background conditions including diel, seasonal and annual variations in pH, or to detect change if change has occurred.
