Regional Board Staff Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. 4 lines of evidence are available in the administrative record to assess this pollutant. 4 of the 339 samples exceeded the CRITERIA. 0 of the 425 samples exceeded the CRITERIA. 0 of the 0 samples exceeded the CRITERIA. In addition, 5 of 23 samples showed biodiversity impacts. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 4 of 339, 0 of 425 and 0 of 0 samples exceeded the CRITERIA and this does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Benthic Response Index (BRI) is a guidance developed by SCCWRP based on changes in biodiversity along a pollutant gradient that is defined by the index values. The index points define specific percentages where the biodiversity of the reference pool is lost. The BRI defines the abundance weighted pollution tolerance of the species present at a site and ranges from Response level RL 1 through 4. Regional Board Staff Conclusion:	303(d) listing decisions made prior to 2006 were not held in an assessment database. However, a USEPA made a finding of non-impairment for sediment toxicity in the Santa Monica Bay TMDL for DDT and PCBs in March 26,2012. "Our evaluation of the data showed only 3 out of 116 samples exhibited toxicity. Following the California listing policy, Santa Monica Bay is meeting the toxicity objective and there is sufficient evidence to delis! sediment toxicity. We therefore make a finding that there is no significant toxicity in Santa Monica Bay and recommend that Santa Monica Bay not be identified as impaired by toxicity in the California's next 303(d) list."
