Regional Board Staff Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. In January 2005, the EPA ban on the production and sale of diazinon went into affect.
3. Data from LOE 2334, with 2 of 22 samples exceeding the criteria, will not be considered in this decision. The data sampled preceded the ban or were sampled shortly after the ban and does represent current conditions.
4.The following information indicates that the water quality standard is attained: zero out of the 36 samples exceed the criteria. Current conditions indicate WQS are being attained.
5. This process is scientifically defensible and reproducible.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

In 10/10/02 during the dry season, and 2/11/03 during the wet season, two (2) samples exceeded the chronic DFG fresh water hazard assessment criteria (one of which also exceeded the acute criteria) for the protection of aquatic life (LACDPW, 2004c).

At this location, which was chosen to avoid tidal influences, the total upstream tributary drainage area for the Los Angeles River is 825 square miles. This river is the largest watershed outlet to the Pacific Ocean in Los Angeles County. At the site, the river is a concrete lined trapezoidal channel.

Regional Board Staff Conclusion: This pollutant is being considered for delisting under sections 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. There are eighteen water samples with 7 samples exceeding the CTR criteria. However, a TMDL is in place to address this pollutant in this water body. The Los Angeles River Metals/Toxics TMDL was approved by the RWQCB in 2005 and subsequently approved by USEPA in 2005.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Staff Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

Regional Board Staff Conclusion: This pollutant is being considered for listing under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. A TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. The Los Angeles River Nitrogen TMDL was approved by RWQCB on August 19, 2003 and subsequently approved by USEPA on March 18, 2004.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
