Draft NPDES Permit for South Bay Power Plant
The State Water Resources Control Board (State Water Board) will accept written comments on the Draft National Pollutant Discharge Elimination System (NPDES) Permit for the South Bay Power Plant (SBPP). A Public Hearing has been scheduled for November 17, 2010 in San Diego, California.

California Independent System Operator Corporation (CAISO) Petition

The California Independent System Operator Corporation (CAISO) filed a petition dated June 11, 2010, with the State Water Resources Control Board (State Board) regarding South Bay Power Plant.  The petition is asking for review of Order No. R9-2010-0062 which was adopted by the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board).  Order No. R9-2010-0062 determined that no changes are warranted to South Bay Power Plant’s NPDES Permit thereby requiring the power plant discharge to terminate on or before December 31, 2010.

The California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) is scheduling a public hearing on May 12, 2010 to receive testimony, technical evidence, and supporting documentation regarding the South Bay Power Plant operations. The public hearing notice is posted below. Dynegy South Bay, LLC, No More South Bay Power Plant Coalition, California Independent System Operator Corporation (CAISO), and the City of Chula Vista are designated parties. The San Diego Water Board will strictly enforce the deadlines and other procedures on written and electronic submissions and exhibits provided in the hearing notice so please review it carefully. The Board may consider adoption of the staff recommendation in Tentative Order No. R9-2010-0062 (posted below), which finds there is insufficient evidence to support early termination of Dynegy’s NPDES permit authorizing discharges from Units 1 and 2 or, based on its review of the record and the hearing, may consider adoption of the Tentative Order with revisions supporting earlier termination.
