City of Brawley
On February 28, 2013 the Colorado River Basin Regional Water Quality Control Board issued Administrative Liability Complaint R7-2013-0028to the City of Brawley for effluent violations and violations of a 2008 Cease and Desist Order.
The 2008 Cease and Desist Order required the City of Brawley to complete POTW upgrades, to fully comply with Waste Discharge Requirements Order R7-2005-0021, and to prepare and submit a pretreatment program for approval and implementation by February 15, 2009.
The City of Brawley failed to develop and adopt local limits and revised its Pretreatment Ordinance. Without such limits there is a substantial threat of harm to water quality. The City of Brawley is working to develop these limits and achieve full compliance with the remaining requirements of the order. Failure to achieve compliance subjects the City of Brawley to additional enforcement.
The Regional Water Board has reached a tentative settlement with the City of Brawley, which will go before the Regional Board in September 2013. The settlement requires the payment of $1 million to the State Water Resources Control Board’s Cleanup and Abatement Account.
