Two lines of evidence are available in the administrative record to assess this pollutant. The single sample exceeded the water quality objective for Water Contact Recreation, but did not exceed the objective for Non-Contact Recreation.

Note that this waterbody is currently on the section 303(d) list in the Water Quality Limited Segments category for pathogens (based on data and information from the California Department of Heal Services from the 1980's). Staff cannot obtain their data but until evidence that the waterbody is not longer impaired it will remain listed for the general category of pathogens. This single sample supports that listing.

Twi lines of evidence are available in the administrative record to assess these pollutants. Two water quality objectives are assessed: Neither of the samples exceed the dissolved oxygen water quality objective for Cold Freshwater Habitat or the general water quality objective for oxygen saturation (when applied as a single sample maximum). The Basin Plan objective states that the median oxygen saturation value shall not fall below 85% and the median value did not exceed this criterion.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Three lines of evidence are available in the administrative record to assess this pollutant. The sample did not exceed the water quality objectives for Warm Freshwater Habitat, Water Contact Recreation or Non-Contact Recreation.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. The sample did not exceed the water quality objectives for Warm Freshwater Habitat, Water Contact Recreation or Non-Contact Recreation and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. The sample size is insufficient to determine with the power and confidence of the Listing Policy if water quality standards are being met.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Data Used to Assess Water Quality: RWQCB staff have stated that State Mussel Watch, Toxic Substances Monitoring Programs and Regional Board sampling were probably used to develop this listing. The specific sample data referenced cannot be located in Regional Board files and exceedances cannot be verified. According to Dave Hubbard (UCSB), the fact that silver and copper associate with industrial activities was a possible reason the Slough was listed. However, these types of practices have not been occurring since the 1980s and are probably not a source of impairment any longer.

It is unknown why the Slough was listed as impaired for metals in the first place.
