Regional Board Conclusion:	This pollutant is being considered for removal on the section 303(d) list under sections 4.4 of the Listing Policy. Under 4.4 of the Policy, a minimum of one line of evidence is needed to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. The Basin Plan lists beneficial uses for waters in the Los Angeles Region. Page 2-10 of the Basin includes the beneficial use listings for Malibu Lagoon. Currently, the Basin Plan does not identify shellfish harvesting as an existing, potential, or intermittent beneficial for Malibu Lagoon. The Office of Environmental Health Hazard Assessment has yet to issue a fish or shellfish advisory for Malibu Lagoon. As such, based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because Malibu Lagoon does not have recognized Shellfish Harvesting beneficial use in the Basin Plan nor has been issued a fish or shellfish advisory.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.9 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The Malibu Lagoon Restoration Feasibility Study Final Alternatives Analysis describes restoration measure for Malibu Lagoon. These proposed restoration efforts, if fully implemented, is anticipated to correct the conditions which allow the negative indicator species to thrive. 2. The Regional Board decided against moving the Benthic Community Effects listing in Malibu Lagoon from the TMDL required portion of the 303(d) list to the being addressed by action other than TMDL portion of the 303(d) list.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under section 4.2 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. This line of evidence was probably used to place the water body pollutant combination on the 2002 303(d) list originally. Thirty-three samples exceeded the water quality objective when the water body was listed. However, twenty-two exceedances or less would be required in order to delist the water body pollutant combination to provide the adequate confidence and power that standards are being met in accordance with the Listing Policy. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1.The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2.The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3.Thirty-three of 138 samples exceeded the pH water quality objective and this exceeds the allowable limit in Table 4.2 of the Listing Policy. 4.Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
