Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.3 (Bacteria) of the Listing Policy. Under section 4.3 a single line of evidence is adequate to assess listing status. The Pajaro River Fecal Coliform TMDL (including Pajaro River, San Benito River, Llagas Creek and Tequisquita Slough) was approved by the Central Coast Regional Board on March 20, 2009 and is currently awaiting to be heard by the State Board. Three lines of evidence are available in the administrative record to assess this pollutant. However, all of the data contained in LOE 1861 is also contained in LOE 10356, as well as additional data collected monthly in 2005. Therefore, LOE 1861 is not included in this decision. Thirty of 85 samples exceed the water quality objective for Water Contact Recreation. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Thirty of 85 samples exceed the water quality objective for Water Contact Recreation and this exceeds the maximum allowable frequency necessary to delist, as listed in or calculated from Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy. Fifteen lines of evidence are available in the administrative record to assess these pollutants. Two water quality objectives are assessed: 294 of 966 samples exceed the dissolved oxygen water quality objective for Cold Freshwater Habitat and 40 of 109 samples exceed the general water quality objective for oxygen saturation (when applied as a single sample maximum). However, the Basin Plan objective states that the median oxygen saturation value shall not fall below 85% and the median value did not exceed this criterion, so using this objective the beneficial use is not impaired. Only 60 of 966 samples exceeded the water quality objective for Warm Freshwater Habitat and therefore this beneficial use is fully supported. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of maintaining this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. A total of 294 of 966 samples exceed the dissolved oxygen water quality objective for Cold Freshwater Habitat and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Under section 3.1 a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. Only one of the 86 samples exceeds the General water quality objective as it applies to the Cold Freshwater Habitat beneficial use. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. Under section 3.2 a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. Seventy-four of 980 samples exceed the Evaluation Guideline (Moyle 1976) applied to protect the Cold Freshwater Habitat beneficial use. Under section 3.1 a single line of evidence is necessary to assess listing status. Twelve lines of evidence are available in the administrative record to assess this pollutant in water samples. None of the samples were toxic to test organisms (exhibited a significant increase in mortality or decrease in cell density compared to the laboratory control) and therefore do not exceed the narrative General Objective for toxicity, set to protect for aquatic life beneficial uses. The following is a summary of the results from individual toxicity tests. Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.1 of the Listing Policy. Four lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.1 the site exceeded numeric objectives for toxic pollutants. Using the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.1. Three of the 6 samples exceed the Evaluation Guideline (Sipmann and Finlayson, 2000) applied to protect for aquatic life beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Three of the 6 samples exceed the Evaluation Guideline (Sipmann and Finlayson, 2000) applied to protect for aquatic life beneficial uses and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy. Four lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.2 the site exceeded numeric objectives for conventional pollutants. According to the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.2. Four hundred and two of 1056 samples exceed the water quality objectives for Agricultural Supply. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy. Six lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.2 the site exceeded numeric objectives for conventional pollutants. According to the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.2. One hundred twenty-five of 261 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses. A recent publication (Steelhead/Rainbow Trout (Oncorhynchus mykiss) Resources South of the Golden Gate, California (Becker, G.S and I.J Reining, October 2008) identifies Llagas Creek as having "Definite run or population" and although the Chesbro Dam does not have "minimum release requirements" in place to sustain flows in the summer months, adult and young of the year have been observed on multiple occasions. Therefore this turbidity guideline is relevant to the waterbody. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One hundred twenty-five of 261 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant was listed under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. The Pajaro River Nutrients TMDL (which specifically includes Llagas Creek) was approved by the RWQCB in December 2005 and subsequently approved by USEPA in 2006. This document primarily addresses nitrate. Therefore, ammonia is addressed in a separate decision. This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Seven lines of evidence are available in the administrative record to assess this pollutant. Two of these LOEs (#1864 and 1866) were placeholder LOEs for previous listings. One was for a Nitrate listing and the other was for this Nutrient listing and both contained no data. The previous nitrate listing is now combined with this Nutrient listing to be consistent with the USEPA approved TMDL. The Staff did not reconstruct the original data used for these listings. However, currently available data shows that 451 of 1284 samples exceed the water quality objective for Municipal and Domestic Supply and this continues to support evidence of impairment. The Agricultural Supply beneficial use is fully supported; only 39 of 1215 samples exceed this objective. Based on the readily available information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four Hundred fifty-one of 1284 samples exceed the water quality objective for Municipal and Domestic Supply and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. The USEPA final decision on the 2006 303(d) list was to move this listing to the 'being addressed by a USEPA approved TMDL' portion of the 303(d) list, because a TMDL and implementation plan has been approved for this water segment-pollutant combination by USEPA on 10/13/2006 (USEPA, 2007).

Regional Board Conclusion:	This pollutant is being considered for listing under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. The Pajaro River Siltation/Sedimentation (including San Benito R., Llagas Cr., Rider Gulch Cr.) TMDL and implementation plan was approved for this water segment-pollutant combination by USEPA on 5/03/07. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.2 (Conventional and Other Pollutants) of the Listing Policy. Under section 4.2 a single line of evidence is adequate to assess delisting status. One line of evidence is available in the administrative record to assess this pollutant. Per Table 4.2 of the Policy, a sufficient number of samples exceed the applicable water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Seventy-eight out of 78 samples exceeded the applicable chloride water quality objective and this exceeds the maximum allowable frequency necessary to delist from Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
