Under this section a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant. LOE #1911 is assigned to this reach of San Luis Obispo Creek in Error. The Basin Plan differentiates beneficial uses for this water body depending on whether it is above or below W. Marsh St. The sites with elevated nitrate levels are located below W. Marsh Street. None of the 26 samples collected from San Luis Obispo Creek (above Marsh Street) exceeded the water quality objectives for Municipal & Domestic Supply or Agricultural Supply. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. None of the 26 samples collected from San Luis Obispo Creek (above Marsh Street) exceeded the water quality objectives for Municipal & Domestic Supply or Agricultural Supply and this does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded in this reach of San Luis Obispo Creek. The listing was incorrectly assigned to this reach prior to 2006.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. None of the 26 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Interpretation of adverse effect shall be as derived from the University of California Agricultural Extension Service guidelines provided in Table 3-3 (Central Coast Waterboard Basin Plan, Chapter III, Section II.A.2 Objectives for all Inland and Surface Waters, Enclosed Bays and Estuaries). Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.1 of the Listing Policy. Two lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.1 the site exceeded numeric objectives for toxic pollutants. Using the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.1. Note that 11 of the 12 exceedances of the Water Contact Recreation objective occur at the Mission Plaza site (310SLM) and only 1 sample exceeds this objective at the upstream site (Cuesta Park, 310SLC). Therefore, the impaired length is Marsh Street Bridge to Cuesta Park. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Twelve of 26 samples exceeded the Water Contact Recreation water quality objective and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
