The Calleguas Creek Historic Pesticides TMDL was approved by RWQCB in 2005 and subsequently approved by USEPA. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four out of 4 samples exceeded the Screening Value. However, a TMDL is in place to address this pollutant in this water body. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

This conclusion is based on the staff findings that: 1. It is unknown whether the data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Six of 12 samples exceeded the nitrate as nitrate (NO3) water quality objective. A TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. At least 28 samples are needed before a pollutant can be considered for removal from the list using the frequencies presented in Table 4.1 of the Listing Policy. 4.Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

Regional Board Conclusion: | This water quality condition is being considered for listing under Water Quality
limited segment being addressed (section 2.2) of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. A TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. The Calleguas Creek Nitrogen TMDL was adopted by RWQCB in October 2002 and was subsequently approved by USEPA in June 20, 2003. Qualitative excess algal growth information is backed by nutrient data and is sufficient to support continued placement on the section 303(d) list (Listing Policy section 3.7). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list. USEPA in its final decision for the 2006 303(d) list added a comment to the being addressed by USEPA approved TMDL portion of the 303(d) List, beneath the named pollutant, that explains that the TMDL covers the effects of Algae. |
