Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant.

Ballona Creek, above Centinela Blvd., is a concrete-lined channel and the Ballona Creek Estuary, below Centinela Blvd., is soft-bottom. Data used in the 1996 WQA to assess Ballona Creek for silver in sediment appear to have been collected from the soft-bottom estuary. Data for silver in sediment from Line of Evidence (LOE) 2366 appears to follow the same pattern and the information described in the LOE will not be considered in this decision. Accordingly, in the Ballona Creek Estuary Toxic Pollutants TMDL, "USEPA and the State found that the Ballona Creek listings for all sediments (cadmium, copper, lead and silver) were made in error and should be applied to the estuary."
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because the original listing was faulty.

Data Used to Assess Water Quality: In the Basin Plan, the transition between Creek and Estuary is at Centinela Blvd. The Ballona Creek Estuary Toxic Pollutants TMDL indicates that, "Ballona Creek (above Centinela) is concrete-lined. Ballona Creek Estuary (below Centinela) is soft-bottomed. Agencies unfamiliar with this regulatory distinction may have inadvertently attributed samples collected from Ballona Creek Estuary to Ballona Creek. Sediment data used in the 1996 WQA appear to have been collected from soft-bottomed Estuary sediments as opposed to the concrete-lined channel."

The Ballona Creek Coliform TMDL was approved by the RWQCB in June of 2006 and subsequently approved by USEPA. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.


State Board Review and Conclusion:

The April 19, 2010 State Water Board staff report for the 2010 Integrated Report
recommended to delist this water body on the 303(d) list for shellfish harvesting advisory based on the following:

The original decision in 2006 to list this water body for shellfish harvesting advisory was based upon flawed information. In 2006 the water body was incorrectly associated with the Ballona Creek Coliform TMDL and was incorrectly listed for shellfish harvesting advisory as Being Addressed By A TMDL. The water body does not possess a Beneficial Use of shellfish harvesting, or commercial and sports fishing. A TMDL has never been approved for this water body pollutant combination.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of removing this water segment-pollutant combination from the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

On August 4, 2010 the State Water Board approved the staff recommendation to
delist this water body-pollutant combination from the 303(d) list (being addressed by USEPA approved TMDL).

In 1998, samples were inadvertently attributed to Ballona Creek but were actually collected from Ballona Creek Estuary. Sediment data used in the 1998 list appear to have been collected from soft-bottomed estuary sediments as opposed to the concrete-lined channel. Therefore, the listing for this pollutant in Ballona Creek was made in error.

Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Four lines of evidence are available in the record to access this pollutant. The total number of sample exceedances from the combined four dissolved copper lines of evidence when compared with CTR dissolved copper criteria exceed the frequency allowed by the Listing Policy.

The Ballona Creek Metals TMDL has been adopted by the Regional Board in July 2005 and by USEPA in December 2005.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

Regional Board Conclusion: 303(d) listing decisions made prior to 2006 were not held in an assessment database. The Regional Boards will update this decision when new data and information become available and are assessed.

A TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. While many of the TMDL implementation measures will address both impairments due to fecal indicator bacteria and enteric viruses, some types of treatment measures (e.g. disinfection) may not adequately address enteric viruses. New standards for enteric viruses are being developed and when they become available, the Regional Board will reconsider the TMDL to incorporate these new standards and will work with responsible agencies to revise the implementation measures as necessary to ensure that these new standards are achieved in the water body.

The USEPA final decision on the 2006 303(d) list was to move this listing to the 'being addressed by a USEPA approved TMDL' portion of the 303(d) list, because the Ballona Creek, Ballona Estuary and Sepulveda Channel Bacteria TMDL was approved by USEPA on March 26, 2007 (USEPA, 2007).
