Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status.
Eight lines of evidence are available in the administrative record to assess this pollutant. Five samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification in favor removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One of 115 available calculated 4-day average diazinon concentrations exceeded the 4-day average diazinon criterion, and this does not exceed criterion more than once every three years. 4. Five of 197 available 1-hour average diazinon concentrations exceeded the 1-hour average diazinon criterion. These exceedances ocurred more than once every three years. Therefore, according to Section 4.11 of the LIsting Policy, the 303(d) listing for diazinon in the Stanisluas River should not be removed. |

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four of 11 samples tested with fathead minnow (chronic toxicity tests) exceeded the narrative toxicity objective and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. In addition, 0 of 13 samples tested with fathead minnow (acute toxicity tests) exceeded the narrative toxicity objective and this does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy. Lastly, 0 of 11 samples tested with ceriodaphnia (acute toxicity tests) exceeded the narrative toxicity objective and this does not exceed the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.
Eight lines of evidence are available in the administrative record to assess this pollutant. Ten samples exceed the narrative toxicity water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Ten of one hundred fifty-two available calculated 4-day average chlorpyrifos concentrations, collected between 2000 and 2006, exceeded the 4-day average chlorpyrifos criterion as follows: 2 exceedances in 2001 and 2001; zero exceedances in 2002; 5 exceedances in 2003; zero exceedances in 2004; 2 exceedances in 2005; and 1 exceedance in 2006. Since there are more than one exceedance every three years, in accordance with Section 3.11 of the Listing Policy and with the maximum exceedance frequency associated with the chlorpyrifos criteria, this water body should be put on the 303(d) list for chlorpyrifos. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

The November 12, 2010 USEPA partial approval letter and the October 11, 2011 final approval letter both from Alexis Strauss, USEPA Region 9, to Tom Howard, SWRCB, concluded the following: USEPA has added Stanislaus River, Lower to the list of water quality limited segments for which a TMDL is required for temperature because applicable water quality standards for this water body are established in the Sacramento and San Joaquin River Basin Plan. Additionally, the Sacramento and San Joaquin River Basin Plan addresses temperature with the following narrative and numeric objectives: "The natural receiving water temperature of intrastate waters shall not be altered unless it can be demonstrated to the satisfaction of the Regional Water Board that such alteration in temperature does not adversely affect beneficial uses. At no time or place shall the temperature of COLD or WARM intrastate waters be increased more than 5 degrees F above natural receiving water temperature. .In determining compliance with the water quality objectives for temperature, appropriate averaging periods may be applied provided that beneficial uses will be fully protected." (RWQCB Central Valley Region, 2009, pp. III-8) Documentation of the natural receiving water temperature is not readily available. An assessment of whether the migration and spawning uses were being achieved was conducted by comparing the current temperatures to the temperature requirements of salmonid species identified in the USEPA Region 10 Guidance for Pacific Northwest State and Tribal Temperature Water Quality Standards (2003a). USEPA believes that the Region10 guidance and its associated Technical Issue Papers provide the most comprehensive compilation of research related to salmonid temperature requirements available. The studies compiled in the guidance and associated papers address the full geographic extent of salmonid populations including California. In this segment, the Chinook salmon adult migration period occurs from river mile 0 (confluence with the San Joaquin River) to river mile 58 (Goodwin Dam) between Sep1-Oct31 (Julian weeks 3643). Stream temperatures were monitored at river miles: 0, 15, 16, 19, 29, 31, 33, 34, 38, 40, 46, 54, and 58 from 1999-2007. Thirty-eight of 76 yearly maximum seven-day averages of maximum daily temperatures (7DADM) values exceeded the 18 deg. C benchmark. The Chinook salmon spawning period occurs from river mile 33 (Jacob Meyers Park) to river mile 58 (Goodwin Dam) between Oct1-Dec15 (Julian weeks 40-50). Stream temperatures were monitored at river miles 33, 34, 38, 40, 46, 54, and 58 from 1999 to 2007. Thirty-eight of 49 yearly maximum 7DADM exceeded the 13 deg. C benchmark. The Chinook salmon smoltification and juvenile rearing period occurs from river mile 0 (confluence with the San Joaquin River) to 58 (Goodwin Dam) between Mar15-Jun15 (Julian weeks 11-24). Stream temperatures were monitored at river miles: 0, 15, 19, 29, 31, 33, 34, 38, 40, 46, 54, and 58 from 1999-2007. Thirty-six of 73 yearly maximum 7DADM values exceeded the 16 degrees C benchmark The Steelhead trout summer rearing period occurs from river mile 45 to 58 (Goodwin Dam) between Jun15-Sep15 (Julian weeks 24-37). This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy (Policy). Six lines of evidence are available in the administrative record to assess this pollutant. These are temperature data on five life stages for anadromous fish and information on the historical and current state of the fishery. A large number of seven-day averages of maximum (7DADM) daily temperatures exceeded the anadromous fish life stage temperature criteria. Based on readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 f the Policy. 3. Thirty-eight of 76 yearly maximum 7DADM values calculated from temperature data collected during the adult migration life stage (Julian weeks 36 through 43) from 1991 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 4. Thirty-eight of 49 yearly maximum 7DADM values calculated from temperature data collected during the spawning life stage (Julian weeks 40 through 50) from 1999 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 5. Thirty-six of 73 yearly maximum 7DADM values calculated from temperature data collected during the smoltification life stage (Julian weeks 11 through 24) from 1999 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 6. Thirty-six of 73 yearly maximum 7DADM values calculated from temperature data collected during the juvenile rearing life stage (Julian weeks 11 through 24) from 1999 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 7. Seven of 27 yearly maximum 7DADM values calculated from temperature data collected during the steelhead summer rearing life stage (Julian weeks 24 through 37) from 1999 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 8. Pursuant to section 3.11 of the Policy, no additional data and information are available indicating that standards are not met. 9. The data used satisfies the data quality requirements of section 6.1.4.5.7 of the Policy. After review of the available data and information, RWQCB-CVR staff concludes that the water body pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. |

At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination. Based on this reevaluation, State Water Board staff continued to support the recommendation to place this water body on the 303(d) list for temperature. The available data demonstrated beneficial uses of the water are impaired due to elevated temperature and the methodology used by the Regional Board staff fully complied with the Listing Policy. At the August 4, 2010 State Water Board's follow-up Board meeting for approval of the 2010 Integrated Report, the State Water Board did not approve the staff recommendation and decided to not place this water body on the 303(d) list for temperature because the evaluation guideline used to support these listing recommendations was not appropriate. After review of this Regional Board decision, the State Water Board recommends that this water body - pollutant combination should not be placed on the section 303(d) list because it cannot be determined if applicable water quality standards are being exceeded. |

Data Used to Assess Water Quality: | The Stanislaus has a good spring and fall-run of salmon (G.H. Clark, 1929). Prior to Tulloch Dam (1958) the average annual fall-run escapement averaged 10,300 spawners (Yoshiyama, Ronald M., Eric R. Gerstun, Frank W. Fisher, and Peter. B. Moyle, 2001). Post Tulloch, escapement declined to an average of 4,300 spawners.
After New Melones Reservoir was operating in the 1970s, annual escapement dropped to an average of 3,600 spawners. Since 2000, the escapement population has steadily declined and by 2006 had dropped to about 65% below the year 2000 peak population. Also, populations have declined when Delta exports and ocean harvesting was reduced at the same time (CDFG July 2007 Letter to the Federal Energy Regulatory Commission). Between 1952 and 2006 the fall-run escapement population has oscillated over time and has dropped to levels less than 1,000 on several occasions. The Department of Fish and Game has submitted data to the Regional Water Quality Control Board regarding warm water temperatures present in the lower Stanislaus River during the fall adult upstream migration seasons for the years 1999 thru 2006 (Tables 7 and 10 in CDFGs Letter to the RWQCB, 2007). Also, the Department of Fish and Game has submitted data to the Regional Water Quality Control Board regarding warm water temperatures present in the lower Stanislaus River spawning habitat reaches during the first half of the spawning season for years 1999 thru 2005 (Table 11 in CDFGs Letter to the RWQCB, 2007). Data collected in 2002 at Orange Blossom Bridge shows as water temperature decreased below 13 degrees C, spawning activity, measured by weekly spawning redd counts, rises (Jason Guignard, 2002). Steelhead in the Stanislaus are considered winter run. Adult steelhead have been recently captured while migrating upstream at the fish counting weir located near Riverbank (Cramer Fish Sciences) Juvenile rainbow trout have been caught in rotary screw traps out-migrating the Stanislaus River. Anecdotal reports by anglers suggest that steelhead populations are good following years where summer rearing conditions are good (e.g. presence of cold water temperatures). State and Federal agencies believe their abundance trends mirrors those of salmon causing them to be listed as threatened in the Central Valley. The Department of Fish and Game submitted data to the Regional Water Quality Control Board regarding warm water temperatures present in the lower Stanislaus River juvenile steelhead rearing reaches during the summer for years 1999 thru 2006 (Table 11 in CDFGs Letter to the RWQCB, 2007). |
