Impairment from Pollutant or Pollution: | Pollutant |
Regional Board Conclusion: | This pollutant is being considered for removal from the section 303(d) list under section 4 of the Listing Policy. Eight lines of evidence are available in the administrative record to assess this pollutant. Three of the samples exceed the narrative toxicity water quality objective.
Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One of 153 available calculated 4-day average concentrations exceeded the 4-day average diazinon criterion, and this does not exceed the 4-day average maximum concentration criterion more than once every three years. 4. Three of 241 available 1-hour average concentrations exceeded the 1-hour average concentration criterion. These exceedances occurred more than once every three years and, Therefore, under section 4.11 of the Listing Policy, this water body should not be delisted. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded. |
State Board Review of Regional Board Conclusion and Recommendation:
State Board Decision Recommendation: | After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board. |
USEPA Action (if applicable): | USEPA approved the listing of this water body as a water quality limited segment requiring a TMDL for this pollutant. |

Region 5 |
Tuolumne River, Lower (Don Pedro Reservoir to San Joaquin River) |
||
Pollutant: | Unknown Toxicity |
Final Listing Decision: | Do Not Delist from 303(d) list (TMDL required list) |
Last Listing Cycle's Final Listing Decision: | New Decision |
Revision Status | Revised |
Sources: | Source Unknown |
Expected TMDL Completion Date: | 2022 |
Impairment from Pollutant or Pollution: | Pollutant |
Regional Board Conclusion: | This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.
Three lines of evidence are available in the administrative record to assess pollutant. Eight out of 23 samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Eight of 23 samples exceeded the water quality objective and this is not enough information to determine whether or not this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.
One line of evidence is available in the administrative record to assess this pollutant. None of the samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. None of 15 samples exceed the California Toxics Rule 4-day average criteria for dissolved Copper and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. One of the samples exceeded the Evaluation Guideline for dimethoate amd, therefore exceeded the narrative toxicity water quality objective.
3. One of 23 water samples had a level of dimethoate that exceeded the Evaluation Guideline of 0.2 ug/L (one-tenth of the LC50 for dimethoate tested on Cyclops strenuus, a Cyclopoid copepod) the most sensitive freshwater species, ), and, therefore, one sample exceeded the narrative toxicity objective, and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. |

The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. None of 65 available 4-day average concentrations exceeded criterion continuous concentration (CCC) and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. In addition, 0 of 91 available 1-hour average concentrations exceeded 1-hour criterion concentration and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

Regional Board Conclusion: | This pollutant is being considered for listing under sections 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Data is available from 2 lines of evidence for this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification for placing this water segment-pollution combination on the section 303(d) list. The recommendation is based on staff findings that 3 of 130 available concentrations exceeded the water quality objective and this does not exceed the allowable frequency using Table 3.2 of the Listing Policy. BinBal recommends listing if a sample size of 130 has 22 or more samples that exceed the evaluation criteria.
The data used satisfies the data quality requirements of section 6.1.4 of the Policy. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. |

Eight lines of evidence are available in the administrative record to assess this pollutant. Eleven samples exceed the water quality objective.
3. Eleven of 145 available 4-day average chlorpyrifos concentrations exceeded the 4-day average maximum chlorpyrifos concentration criterion more than once every three years and, therefore, according to Section 3.11 of the Listing Policy, this water body should be put on the 303(d) list. 4. Four of 247 available 1-hour average chlorpyrifos concentrations exceeded the 1-hour average maximum chlorpyrifos concentration criterion more than once every three years and, therefore, according to Section 3.11 of the Listing Policy, this water body should be put on the 303(d) list. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. |

Nineteen of the samples exceed the water quality objective.
3. Nineteen of 38 samples exceeded the USEPA fish tissue criterion for human health and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. |

Regional Board Conclusion: | USEPA Final Approval Decision Details:
The November 12, 2010 USEPA partial approval letter and the October 11, 2011 final approval letter both from Alexis Strauss, USEPA Region 9, to Tom Howard, SWRCB, concluded the following: USEPA has added Tuolumne River, Lower (Don Pedro Reservoir to San Joaquin River) to the list of water quality limited segments for which a TMDL is required for temperature because applicable water quality standards for this water body are established in the Sacramento and San Joaquin River Basin Plan. Additionally, the Sacramento and San Joaquin River Basin Plan addresses temperature with the following narrative and numeric objectives: "The natural receiving water temperature of intrastate waters shall not be altered unless it can be demonstrated to the satisfaction of the Regional Water Board that such alteration in temperature does not adversely affect beneficial uses. At no time or place shall the temperature of COLD or WARM intrastate waters be increased more than 5 deg. F above natural receiving water temperature. In determining compliance with the water quality objectives for temperature, appropriate averaging periods may be applied provided that beneficial uses will be fully protected." (RWQCB Central Valley Region, 2009, pp. III-8) Documentation of the natural receiving water temperature is not readily available. An assessment of whether the migration and spawning uses were being achieved was conducted by comparing the current temperatures to the temperature requirements of salmonid species identified in the USEPA Region 10 Guidance for Pacific Northwest State and Tribal Temperature Water Quality Standards (2003a). USEPA believes that the Region 10 guidance and its associated Technical Issue Papers provide the most comprehensive compilation of research related to salmonid temperature requirements available. The studies compiled in the guidance and associated papers address the full geographic extent of salmonid populations including California. In this segment, the Chinook salmon adult migration period occurs from river mile 3.4 (Shiloh Bridge) to river mile 52 (La Grange Powerhouse) between Sep1-Oct31 (Julian wks 36-43). Stream temperatures were monitored at river miles: 3.4, 12, 16, 16.3, 19, 21, 23.6, 26, 31, 32, 33, 35, 36.5, 36.7, 38, 39.5, 42.6, 42.9, 43.2, 43.4, 45, 45.5, 45.7, 47.5, 48.8, 49, 49.7, 50.5, 50.8, 51.6 and 52 from 1991 to 2007. Eighty three of 145 yearly maximum 7-day averages of maximum daily temperatures (7DADM) values exceeded the 18 deg. C benchmark. The Chinook salmon spawning period occurs from river mile 26 (Fox Grove) to river mile 52 (La Grange Powerhouse) between Oct1-Dec15 (Julian wks 40-50). Stream temperatures were monitored at river miles: 26, 31, 32, 33, 35, 36.5, 36.7, 38, 39.5, 42.6, 42.9, 43.2, 43.4, 45, 45.5, 45.7, 47.5, 48.8, 49, 49.7, 50.5, 50.8, 51.6 and 52 from 1996 to 2007. One hundred and two of 118 yearly maximum 7DADM values exceeded the 13 deg. C benchmark. The Chinook salmon smoltification and juvenile rearing period occurs from river mile 3 (Grayson Rotary Screw Trap) to river mile 52 (La Grange Powerhouse) between Mar15-Jun15 (Julian wks 11-24). Stream temperatures were monitored at river miles: 3, 3.4, 12, 16, 16.3, 19, 21, 23.6, 26, 31, 32, 33, 35, 36.5, 36.7, 38, 39.5, 42.6, 42.9, 43.2, 43.4, 45, 45.5, 45.7, 47.5, 48.8, 49, 49.7, 50.5, 50.8, 51.6 and 52 from 1997 to 2008. Seventy-five of 137 yearly maximum 7DADM values exceeded the 16 deg. C benchmark. The Steelhead trout summer rearing period occurs from river mile 42.6 (Riffle K1) to river mile 52 (La Grange Powerhouse) between Jun15-Sep15 (Julian wks 24-37). Stream temperatures were monitored at river miles: 42.6, 42.9, 43.2, 43.4, 45, 45.5, 45.7, 47.5, 48.8, 49, 49.7, 50.5, 50.8, 51.6 and 52 from 1998 to 2007. Twenty-six of 78 yearly maximum 7DADM values exceeded the 18 degrees C benchmark. For clarification, the Regional Water Board and State Water Board decision recommendations prior to USEPA's final decision are presented below: Note: All LOEs have been revised where necessary to reflect USEPA's final decision. |
Regional Board Decision Recommendation: | Regional Board Decision Recommendation (prior to State Water Board approval):
This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy (Policy). Six lines of evidence are available in the administrative record to assess this pollutant. These are temperature data on five life stages for anadromous fish and information on the historical and current state of the fishery. A large number of seven-day averages of maximum (7DADM) daily temperatures exceeded the anadromous fish life stage temperature criteria. Based on readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Eighty-five of 147 yearly maximum 7DADM values calculated from temperature data collected during the adult migration life stage (Julian weeks 36 through 43) from 1996 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 4. One hundred two of 118 yearly maximum 7DADM values calculated from temperature data collected during the spawning life stage (Julian weeks 40 through 50) from 1996 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 5. Seventy-five of 137 yearly maximum 7DADM values calculated from temperature data collected during the smoltification life stage (Julian weeks 11 through 24) from 1997 to 2008 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 6. Seventy-five of 137 yearly maximum 7DADM values calculated from temperature data collected during the juvenile rearing life stage (Julian weeks 11 through 24) from 1997 to 2008 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 7. Twenty-six of 78 yearly maximum 7DADM values calculated from temperature data collected during the steelhead summer rearing life stage (Julian weeks 24 through 37) from 1998 to 2007 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy. 8. Pursuant to section 3.11 of the Policy, no additional data and information are available indicating that standards are not met. 9. The data used satisfies the data quality requirements of section 6.1.4.5.7 of the Policy. After review of the available data and information, RWQCB-CVR staff concludes that the water body pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. |
State Board Review of Regional Board Conclusion and Recommendation: | For clarification, the Regional Water Board and State Water Board decision recommendations prior to USEPA's final decision are presented below:
Note: All LOEs have been revised where necessary to reflect USEPA's final decision. |
State Board Decision Recommendation: | State Board Decision Recommendation (prior to USEPA approval):
At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination. Based on this reevaluation, State Water Board staff continued to support the recommendation to place this water body on the 303(d) list for temperature. The available data demonstrated beneficial uses of the water are impaired due to elevated temperature and the methodology used by the Regional Board staff fully complied with the Listing Policy. At the August 4, 2010 State Water Board's follow-up Board meeting for approval of the 2010 Integrated Report, the State Water Board did not approve the staff recommendation and decided to not place this water body on the 303(d) list for temperature because the evaluation guideline used to support the listing recommendation was not appropriate. After review of this Regional Board decision, the State Water Board recommends that this water body - pollutant combination should not be placed on the section 303(d) list because it cannot be determined if applicable water quality standards are being exceeded. |
USEPA Action (if applicable): | USEPA identified this water body as a water quality limited segment requiring a TMDL for this pollutant. |

Data Used to Assess Water Quality: | In 1830 John Marsh noted that the Tuolumne River “particularly abounds with Salmon.” In 1849 Samuel Ward recalled a “plenteous fish summer of salmon, caught by rifle shot in the lower Tuolumne River.” A later historical account noted native people caught enough salmon to last all year. In 1929 G.H. Clark stated: The spawning run of the salmon…is during the spring and fall. The spawning grounds extend from Waterford to La Grange.” After the construction of the La Grange Dam, G.H. Clark noted, “the spring run amount to almost nothing but some fish come up in the fall.”
Historical annual salmon escapement trends from 1940 to 2006 shows production steadily decreasing and may reach a point the population could become extinct given enough successive dry years. Pre New Don Pedro dam, escapement numbers averaged 28,000 fish per year. Post New Don Pedro dam, escapement numbers dropped to an average 6,000 fish per year. By 2000 (peak abundance that year 17,875 salmon) the fall run escapement population steadily declined and by 2006 had dropped to about 97% (500 salmon) below the year 2000 peak abundance. The Department of Fish and Game submitted data to the Regional Water Quality Control Board regarding warm water temperatures present in the lower Tuolumne River during the fall adult upstream migration season for the years 1998 thru 2005 (Tables 8 and 10 in CDFGÂ’s Letter to the RWQCB dated February 2007). Also, CDFG submitted data to the RWQCB regarding warm water temperatures present in the lower Tuolumne River spawning habitat reaches during the first half of the spawning season for years 1998 thru 2005 (Table 12 in CDFGÂ’s Letter to the RWQCB dated February 2007). Steelhead in the Tuolumne are considered winter run. Adult catch is considered infrequent. Juvenile rainbow trout out migrating the Tuolumne River are caught annually in seining surveys conducted by the Turlock Irrigation District. Anecdotal reports by anglers suggest that steelhead populations are good following years where summer rearing conditions are good (e.g. presence of cold water temperatures). State and Federal agencies believe their abundance trends mirrors those of salmon causing them to be listed as threatened in the Central Valley. The Department of Fish and Game submitted data to the Regional Water Quality Control Board regarding warm water temperatures present in the lower Tuolumne River juvenile steelhead rearing reaches during the summer for years 2001 thru 2006 (Table 19 in CDFGÂ’s Letter to the RWQCB, 2007). |

Water Quality Objective/Criterion: | The natural receiving water temperature of intrastate waters shall not be altered unless it can be demonstrated to the satisfaction of the Regional Water Board that such alteration in temperature does not adversely affect beneficial uses.

Evaluation Guideline: | In the absence of necessary data to interpret numeric water quality objectives, recent temperature monitoring data shall be compared to the temperature requirements of aquatic life in the water segment. In many cases, fisheries, particularly salmonids, represent the beneficial uses most sensitive to temperature. Information on current and historic conditions and distribution of sensitive beneficial uses (e.g., fishery resources) in the water segment is necessary, as well as recent temperature data reflective of conditions experienced by the most sensitive life stage of the aquatic life species. If temperature data from past (historic) periods corresponding to times when the beneficial use was fully supported are not available, information about presence/absence or abundance of sensitive aquatic life species shall be used to infer past (historic) temperature conditions if loss of habitat, diversions, toxic spills, and other factors are also listed (SWRCB, 2004).

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.10 of the Listing Policy. Under section 3.10 a single line of evidence is necessary to assess listing status.
One line of evidence is available in the administrative record to assess this pollutant. Three studies, two in 1969-1971 and one in 1986 were used for this assessment, which showed an overall increase of native and non-native species over time. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. Three studies were conducted, two in 1969-1971 and one in 1986. 2. Baseline data was taken from the 1969-1971 studies. All three studies sampled the same geographic area, with similar sampling sizes. 3. Rank abundance, Pearson product moment correlations, and principal components analysis were the statistical analyses employed during these studies. 4. The comparison showed a net increase of native and non-native species observed at all sampling sites. The data was based on the percentage of sites the species were collected at for each study. 5. Some native species were collected at more sites in 1986 than in 1969-71. Some non-native species were collected at more sites than in 1969-71. Eight native species increased in the watersheds they were observed from 1969-71 to 1986, while 5 native species decreased. Nine non-native species increased over time from 1969-71 to 1986, while 7 non-native species decreased. 6. It cannot be determined if the trend in water quality is expected to meet water standards by the next listing cycle. 7. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | This is a decision made by the State Water Resources Control Board and approved by the USEPA in 2006 . No new data were assessed by the Regional Board for 2008. The decision has not changed. |

Data Used to Assess Water Quality: | Two previous studies (conducted in 1969-71) (Moyle and Nichols, 1973; Moyle and Nichols, 1974) were used as baseline comparisons to a study conducted in 1986 (Brown and Moyle, 1993). Species percent collection data were the same for each baseline study at the sampling sites. The baseline studies and this study sampled the same geographic area, with similar sampling sizes. The baseline data was compared to the data collected in 1986. The comparison showed an overall net increase of native species observed at all sampling sites, as well as a net increase in non-native species. The data was based on the percentage of sites the species were collected at for each study. Overall, some native species were collected at more sites in 1986 (an increase in percent) than in the 1969-71 studies (Brown and Moyle, 1993). Some non-native species were collected at more sites (an increase in percent) than in the 1969-71 studies. Eight native species increased in the watersheds they were observed (collected at more sites over time) from 1969-71 to 1986, while 5 native species decreased (collected at less sites over time). Nine non-native species increased over time (collected at more sites over time) from 1969-71 to 1986, while 7 non-native species decreased (collected at less sites over time).
