For the San Joaquin River at Airport Way Bridge, nr. Vernalis, from 15 March to 15 September, the boron water quality objective is 2.0 mg/L (max.) and 0.8 mg/L (monthly mean); from 16 September to 14 March the water quality objective is 2.6 mg/L (max.), 1.0 mg/L (monthly mean). During Critical years the water quality objective is 1.3 mg/L (monthly mean only).

Spatial Representation: Samples were collected from San Joaquin River at Airport Way Bridge, nr. Vernalis.
Temporal Representation: Samples were collected approximately weekly between March 2000 and June 2006. Listing Policy Section 6.1.5.3 (Temporal Representation) allows use of only recently collected data when implementation of a management practice results in a change to a water body segment (SWRCB, 2004). For this evaluation, due to the similarities between electrical conductivity and boron, there was a determination to use the same approach for temporal representation as used in the electrical conductivity evaluation for the same water body. Thus for purposes of this 303(d) listing determination at Vernalis, Water Rights D-1641 requirements were considered a salinity management practice change and thus data was limited to samples collected after 29 December 1999.

The 7 data were collected in one storm in 2001. Thirdly, 0 of 118 more recent available 1-hour average concentrations (TMDL monitoring data from 2003 to 2006) exceeded the 1-hour average concentration criterion and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy and the 1-hour average concentration criterion more than once every three years (Sections 3.11 of listing policy). In addition, 9 of 23 samples tested with fathead minnow (7-day chronic toxicity test) exceeded the narrative toxicity objective and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. Lastly, 0 of 43 samples tested with ceriodaphnia exceeded the narrative toxicity objective and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Conclusion: This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Nine lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard..

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 4.1 of the Policy.
2. The data used satisfies the data quantity requirements of section 4.1 of the Policy.
3. Eight of 306 available 4-day average concentrations exceeded the 4-day average maximum concentration criterion more than once every three years. In addition, 5 of 416 available 1-hour average concentrations exceeded the 1-hour average concentration criterion more than once every three years.
4. The San Joaquin River Diazinon and Chlorpyrifos TMDL has been approved by the RWQCB in 2005 and approved by USEPA on December 20, 2006.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

One lines of evidence is available in the administrative record to assess this pollutant. None of the samples exceeded the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Seventy-one of 2861 thirty-day running-average mean-daily records exceeded the water quality objective and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.


State Board Decision Recommendation:

At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination. Based on this reevaluation, State Water Board staff recommended to not remove this water body from the 303(d) list for electrical conductivity based on a limited amount of data from consecutive critically dry years.

On August 4, 2010 the State Water Board approved the staff listing recommendation to not delist this water body from the 303(d) list for electrical conductivity.

The 2010 303(d) list transmittal letter from Thomas Howard, SWRCB, to Alexis Strauss, USEPA Region 9, dated October 11, 2010 identifies this water body pollutant combination as being held in abeyance due to existing litigation.

This water body segment has a USEPA approved TMDL for salt and boron and while the listing is "held in abeyance", the TMDL is still an approved TMDL and will remain listed as a water body segment with an approved TMDL on California's Category 5 303(d) list.

In addition, there are other pollutants for this water body segment that still require the development of a TMDL. Once all the pollutants for this water body segment have USEPA approved TMDLS, the water body will be moved to Category 4A and then delisted as monitoring shows an improvement in water quality.

Data was collected hourly and was averaged according to the averaging period specified for the Vernalis EC objectives in the Bay-Delta Plan (2006). A total of 2,861 30-day running-average mean-daily records were compiled, including 1,223 records during April to August and 1,610 records from September to March. Thirty-day running averages of mean daily EC values were evaluated for the San Joaquin River at Airport Way Bridge nr. Vernalis, CA between 29 December 1999 and 30 September 2007. The period of record evaluated was extended through the 2007 Water Year to include one critically dry year in the period. Temporal Representation: Listing Policy Section 6.1.5.3 (Temporal Representation) allows use of only recently collected data when implementation of a management practice results in a change to a water body segment (SWRCB, 2004). For purposes of salinity 303(d) listing determination at Vernalis, Water Rights D-1641 requirements were considered a salinity management practice change and thus analysis was limited from 29 December 1999 until the end of the 2007 water year (30 September 2007).In 1973, the State Water Resources Control Board (State Water Board) adopted D-1422 which required the USBR to meet a Vernalis salinity objective. D-1422 required releases of conserved water from New Melones Reservoir to meet the salinity objective; however the Reservoir was not fully operational until1979.In 1991, the State Water Board adopted the Water Quality Control Plan for the San Francisco Bay/Sacramento-San Joaquin Delta Estuary (Bay-Delta Plan) which included the requirements of D-1422. It also included Interim Stage 2, to be implemented by 1994, which revised the Vernalis salinity objective from a measurement of total dissolved solids to electrical conductivity (EC). This EC objective was included in both the 1995 and 2006 Bay-Delta Plans and remains in effect today. Implementation of the1995 Bay-Delta Plan, including meeting the new EC salinity objective at Vernalis, began with interim water rights orders #95-06, #95-14, and #98-09, which required USBR to make releases from New Melones Reservoir. On 29 December 1999, the State Water Board adopted D-1641, which provided the Program of Implementation for the Bay-Delta Plan. D-1641 required the USBR to meet the Vernalis objective using any measures available to it. (D-1641 pg 89, 1999). (Remaining text continued under "Environmental Conditions" below)

Though the time period of data considered here was limited based on the implementation of D-1641 by USBR using freshwater flows, D-1641 states that implementation of the Vernalis objective could be accomplished using other actions as well, such as control of saline agricultural drainage or subsurface accretions to the river from groundwater. Thus nothing in this analysis is intended to contradict the findings of D-1641 or to in any way change the existing requirements in the Central Valley Water Board phased program to control salt and boron in the lower San Joaquin River (TMDL).

A total of 2,861 30-day running-average mean-daily records were compiled, including 1,223 records during April to August and 1,610 records from September to March. Thirty-day running averages of mean daily EC values were evaluated for the San Joaquin River at Airport Way Bridge nr. Vernalis, CA between 29 December 1999 and 30 September 2007. The period of record evaluated was extended through the 2007 Water Year to include one critically dry year in the period. The period of data evaluated included two wet years, one above average year, one below average year, three dry years, and one critical year, per the San Joaquin Valley Water Year Index as described in the Bay-Delta Plan (2006).

Spatial Representation: Continuous records of EC were collected at the San Joaquin River at Airport Bridge, near Vernalis in San Joaquin County, California.
Temporal Representation: Though data analyzed is limited to recently collected samples, salinity monitoring of the San Joaquin River at Vernalis dates back to at least the 1930s. Salinity measurements, including EC and/or total dissolved solids (TDS), has been monitored periodically and/or continuously at this site at various times by many agencies including the California Department of Water Resources, the Central Valley Regional Water Quality Control Board, the U.S. Geological Survey, USBR, and possibly others. Many of these past sample results are contained in an Interagency Ecological Program (IEP) database, which houses samples from July 1964 through December 1998. USBR provided the EC data from June1993 until present.
Environmental Conditions: Over time, a number of major hydrological modifications have taken place in the San Joaquin River watershed that has impacted flows and salinity levels observed at Vernalis. In 1942, the completion of Friant Dam resulted in the diversion of the upper San Joaquin River into USBR Central Valley Project (CVP) facilities (north into the Madera Canal and south into the Friant-Kern Canal). In 1951, water from the Delta was delivered to Mendota through the Delta-Mendota Canal, in exchange for the water that had been diverted upstream at Friant Dam. Other flow management changes have included retention of water behind dams on the Fresno River, the Chowchilla River, the Merced River, the Tuolumne River and the Stanislaus River.

Regional Board Conclusion: USEPA Final Approval Decision Details:

The November 12, 2010 USEPA partial approval letter and the October 11, 2011 final approval letter both from Alexis Strauss, USEPA Region 9, to Tom Howard, SWRCB, concluded the following:

USEPA has added San Joaquin River (Stanislaus River to Delta Boundary) to the list of water quality limited segments for which a TMDL is required for temperature because applicable water quality standards for this water body are established in the Sacramento and San Joaquin River Basin Plan. Additionally, the Sacramento and San Joaquin River Basin Plan addresses temperature with the following narrative and numeric objectives:

"The natural receiving water temperature of intrastate waters shall not be altered unless it can be demonstrated to the satisfaction of the Regional Water Board that such alteration in temperature does not adversely affect beneficial uses. At no time or place shall the temperature of COLD or WARM intrastate waters be increased more than 5 degrees F above natural receiving water temperature. In determining compliance with the water quality objectives for temperature, appropriate averaging periods may be applied provided that beneficial uses will be fully protected." (RWQCB Central Valley Region, 2009, pp. III-8)

Documentation of the natural receiving water temperature is not readily available. An assessment of whether the migration and spawning uses were being achieved was conducted by comparing the current temperatures to the temperature requirements of salmonid species identified in the USEPA Region 10 Guidance for Pacific Northwest State and Tribal Temperature Water Quality Standards (2003a). USEPA believes that the Region10 guidance and its associated Technical Issue Papers provide the most comprehensive compilation of research related to salmonid temperature requirements available. The studies compiled in the guidance and associated papers address the full geographic extent of salmonid populations including California.

In this segment, the Chinook salmon adult migration period occurs from river mile 71 (Durham Ferry) to river mile 74.5 (above Two Rivers) between Sep 1-Oct 31 (Julian weeks 36-43). Stream temperatures were monitored at river miles: 71, 73.5, 74 and 74.5 from 2001 to 2005. Thirteen of 13 yearly maximum seven-day averages of maximum daily temperatures (7DADM) values exceeded the 20 degrees C benchmark.

The Chinook salmon smolt out migration period occurs from river mile 71 (Durham Ferry) to river mile 74 (above Two Rivers) between Mar 15-Jun 15 (Julian weeks 11-24). Stream temperatures were monitored at river miles: 71, 73.5, and 74 from 2002 to 2005. Five of 7 yearly maximum 7DADM values exceeded the 20 degrees C benchmark.

Three lines of evidence are available in the administrative record to assess this pollutant. These are temperature data on two life stages for anadromous fish and information on the historical and current state of the fishery. A large number of seven-day averages of maximum (7DADM) daily temperatures exceeded the anadromous fish life stage temperature criteria.

Based on readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Thirteen out of 13 yearly maximum 7DADM values calculated from temperature data collected during the adult migration life stage (Julian weeks 36 through 43) from 2001 through 2005 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy.
4. Five of 7 yearly maximum 7DADM values collected during the smoltification life stage (Julian weeks 11 through 24) from 2002 to 2005 exceeded the narrative temperature objective, and this exceeds the minimum criteria for listing from Table 3.2 of the Policy.
5. Pursuant to section 3.11 of the Policy, no additional data and information are available indicating that standards are not met.
6. The data used satisfies the data quality requirements of section 6.1.4.5.7 of the Policy.

After review of the available data and information, RWQCB-CVR staff concludes that the water body pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination.

Based on this reevaluation, State Water Board staff continued to support the recommendation to place this water body on the 303(d) list for temperature. The available data demonstrated beneficial uses of the water are impaired due to elevated temperature and the methodology used by the Regional Board staff fully complied with the Listing Policy.

At the August 4, 2010 State Water Board's follow-up Board meeting for approval of the 2010 Integrated Report, the State Water Board did not approve the staff recommendation and decided to not place this water body on the 303(d) list for temperature because the evaluation guideline used to support these listing recommendations was not appropriate.

After review of this Regional Board decision, the State Water Board recommends that this water body - pollutant combination should not be placed on the section 303(d) list because it cannot be determined if applicable water quality standards are being exceeded.

Monitoring occurred from 2001 to 2005 depending on the monitoring station, identified by a river mile. The 7DADM was recorded weekly for each river mile. Data Used to Assess Water Quality: The San Joaquin watershed had a large spring-run of chinook salmon, along with a much smaller fall-run (Hatton and Clark, 1942). By about 1920, chinook salmon populations declined due to changes within the upper San Joaquin watershed. Many changes such as dams, water diversion, mining and harvest have been suggested for their decline. By 1950’s salmon became extinct in the mainstem San Joaquin River and populations of less than 500 were a common occurrence in the Merced, Tuolumne and Stanislaus Rivers.

However, the gradual decline in salmon populations has been tied to the unsuitable high water temperatures, which increases juveniles susceptibility to disease, predation and accumulation of contaminants (Myrick and Cech 2001). Since 1952 there have been several peak escapement trends, but overall, the trend over time to 2006 has been declining dramatically with the 1952 peak of over 8,000 salmon to 1,000 salmon in 2006.

Steelhead, described by Latta (1929, 1949) and other authors write about good numbers and casually being taken by indigeneous peoples. Now the runs are extinct in the mainstem and are listed as a Federally Threatened species.

Evaluation Guideline: In the absence of necessary data to interpret numeric water quality objectives, recent temperature monitoring data shall be compared to the temperature requirements of aquatic life in the water segment. In many cases, fisheries, particularly salmonids, represent the beneficial uses most sensitive to temperature. Information on current and historic conditions and distribution of sensitive beneficial uses (e.g., fishery resources) in the water segment is necessary, as well as recent temperature data reflective of conditions experienced by the most sensitive life stage of the aquatic life species. Data Used to Assess Water Quality: Stream temperatures were measured by California Department of Fish and Game (CDFG) using data loggers (Stowaways, Tidbits and Hobo Temp Pros). Monitoring occurred from 2002 to 2005 depending on the monitoring station, identified by a river mile. The 7DADM was recorded weekly for each river mile. The maximum 7DADM value was calculated for each year. Based on the data provided, 5 out of 7 maximum 7DADM values exceeded the <20 degrees C criteria from 2002 to 2005.
