Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.3 of the Listing Policy. However, on July 19, 2007 USEPA amended the water quality standards for Watsonville Slough and its tributaries (specifically including Gallighan Slough) by removing Shellfish Harvesting as a designated use. Concurrent with the submitted Pathogen TMDL, staff submitted a Use Attainability Analysis (UAA) to amend the beneficial use designations. The USEPA approved the UAA on March 28, 2007.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because the beneficial use was removed.

Objectives for All Inland Surface Waters, Enclosed Bays, and Estuaries (page III-12)) states the following: At all areas where shellfish may be harvested for human consumption, the median total coliform concentration throughout the water column for any 30-day period shall not exceed 70 MPN/100mL, not shall more than ten percent of the samples collected during any 30-day period exceed 230 MPN/100mL for a five tube decimal dilution test.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy. One line of evidence is available in the administrative record to assess this pollutant. Based on section 3.2 the site exceeded numeric objectives for conventional pollutants. According to the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.2. Nine of 12 samples exceed the Evaluation Guideline (Sigler et al., 1984) applied to protect for aquatic life beneficial uses. This supports rejection of the null hypothesis. However, at this time staff are unaware of any documentation of steelhead populations in Gallighan Slough. Therefore this Evaluation Guideline is not relevant for this waterbody. Based on the readily available data and information, there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. At this time staff are unaware of any documentation of steelhead populations in Gallighan Slough. Therefore this Evaluation Guideline is not relevant for this waterbody. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	A TMDL has been approved by USEPA (July 19, 2007) for pathogens in Watsonville Slough and four of its tributaries (specifically Gallighan Slough). Gallighan Slough was not specifically identified on the 2006 Section 303(d) list for this pollutant but was included in the TMDL because it is impaired and the source controls are overlapping. This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. Four of the 9 samples, tested for E. coli) and 3 of the 9 samples, tested for Fecal Coliform, exceed the water quality objective for Water Contact Recreation. A minimum o f 26 samples are required to determine if water quality standards are being met. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four of the 9 samples, tested for E. coli) and 3 of the 9 samples, tested for Fecal Coliform, exceed the water quality objective for Water Contact Recreation and these exceed the allowable frequency calculated from the equation in Table 4.2 of the Listing Policy. However, the sample size is insufficient to determine with the power and confidence of the Listing Policy if water quality standards are met or exceeded. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list (being addressed by TMDL category) because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.
