Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. One of the samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One of 5 available dissolved Boron concentrations exceeded the water quality objective and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. In addition, 0 of 7 available total Boron concentrations exceeded the water quality objective and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Nine discrete water samples, including two sets of duplicates, were collected from Shag Slough between March 1 2006 and September 22 2006. The nine discrete samples yielded seven averaged total Boron concentrations. Zero of 7 averaged concentrations exceeded the evaluation guideline for Boron.

Five monthly water samples were collected from Shag Slough between March 26 2006 and September 22 2006. One of 5 dissolved water concentrations exceeded the evaluation guideline for (total) Boron. The sample collected on June 26 2006, contained 0.52 mg/L total Boron and 1.1 mg/L dissolved Boron, suggesting that there is a problem with Quality Control for this sample date.

Within the legal boundaries of the Delta, the dissolved oxygen concentration shall not be reduced below: 7.0 mg/l in the Sacramento River (below the I Street Bridge) and in all Delta waters west of the Antioch Bridge; 6.0 mg/l in the San Joaquin River (between Turner Cut and Stockton, 1 September through 30 November); and 5.0 mg/l in all other Delta waters except for those bodies of water which are constructed for special purposes and from which fish have been excluded or where the fishery is not important as a beneficial use.

Arcsin squareroot transformation was used when necessary to meet the assumptions of normality and homogeneity of variance. Steel's Many-One Rank Test was used for comparison to control if these assumptions were not met after transformation.
