Conclusion:	There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.. The Clear Lake Nutrient has been approved by the Central Valley Water Board in 2006 and approved by USEPA on 21 September 2007.

RWQCB Board Staff Decision:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be listed on the section 303(d) list as being addressed by a USEPA approved TMDL

Conclusion:	This water segment-pollutant combination is listed in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list. The Clear Lake watershed contains the Sulphur Bank mercury mine, a USEPA Superfund site. The Clear Lake Mercury TMDL was approved by the RWQCB in 2002 and subsequently approved by USEPA on 10/20/2003. This TMDL is in the implementation phase. Completion of tasks is dependent on funding from federal and state TMDL programs.

RWQCB Board Staff Decision:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

SWRCB Board Staff Decision:	After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.
