| Regional Board Conclusion: | Fecal indicator bacteria (which includes enterococcus, fecal coliform, and total coliform) are being considered for placement on the Section 303(d) list under Sections 3.2 and 3.3 of the Listing Policy. The data assessed are ocean beach fecal indicator bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 3.3 of the Listing Policy a 4% exceedance rate shall be used to add waters from the List "if water quality monitoring was conducted April 1 through October 31 only". If the data collected include months outside the April 1 through October 31 date range, then the data shall be assessed according to Section 3.2 of the Listing Policy, at a 10% exceedance rate.
Data are available for this water body from the 2006, 2010, and 2012 Integrated Reports. Data used in this decision from the 2006 Integrated Report (line of evidence [LOE] 345) were collected April 1 through October 31 only, and therefore are assessed under Section 3.3 of the Listing Policy at a 4% exceedance rate. According to Section 3.3 of the Listing Policy, utilizing a 4% exceedance rate, waters should be listed if the 2006 LOE reflects greater than or equal to 12 of the 123 geometric mean values for enterococcus exceed the objective. The enterococcus geomean values from the 2006 LOE do not exceed the allowable 4% exceedance rate. The 2010 LOEs 25304, 25300, and 25303 have been replaced by LOEs 46785, 46783, 46784 in order to clarify that data presented in the 2010 LOEs were collected April - December 2005 (not April - October as the original LOEs stated). Enterococcus and fecal coliform data from the 2010 (LOEs 46784 and 46783) and 2012 (LOEs 32688, 44731, 44594, and 32690) Integrated Reports were collected including months outside the April 1 through October 31 range, and therefore are assessed under Section 3.2 of the Listing Policy at a 10% exceedance rate. It should be noted that an additional four LOEs for total coliform data were not utilized in this decision because these bacteria are widespread in nature and occur in non-fecal sources such as soil and submerged wood and are not a good measure for the protection of contact recreation beneficial uses. However, the California Ocean Plan has specific total coliform objectives for waters designated for shellfish harvesting (SHELL). Four out 102 samples exceeded the total coliform objective of 70 MPN/100ml expressed as a 30 day rolling geometric mean and four of 114 samples exceeded the single sample SHELL objective of 230 MPN/100mL, both are below the exceedance threshold iterated in section 3.3 of the Listing Policy. In the 2010 Integrated Report, the data results for single sample maximum and geometric mean calculations were presented in the same LOE. In the 2012 Integrated Report, the data results for single sample maximum and geometric mean calculations are presented in two separate LOEs. The following summary presents the total number of exceedances and total sample count from the two listing cycles combined, for single sample maximum separate from geometric mean: 1) Nine of 181 samples exceed the single sample maximum objective for enterococcus; 2) Six of 117 samples exceed the geometric mean objective for enterococcus; 3) Five of 181 samples exceed the single sample maximum objective for fecal coliform; 4) Zero of 117 samples exceed the geometric mean objective for fecal coliform. According to Section 3.2 of the Listing Policy, utilizing a 10% exceedance rate, waters should be listed if the data from the 2010 and 2012 LOEs exceed the objectives more than the allowable frequency identified in Section 3.2 (Table 3.2) of the Listing Policy. This equates to: 1) greater than or equal to 30 of 181 of the single sample values exceeding the objective, or 2) greater than or equal to 20 of 117 of the geometric mean values exceeding the objective. Neither the enterococcus nor the fecal coliform values (both single samples and geomean) from the 2010 and 2012 LOEs exceed the allowable 10% exceedance rate. Under Sections 3.2 and 3.3 of the Listing Policy, a single LOE is necessary to assess listing status. Six LOEs are available in the administrative record from the 2010 and 2012 Integrated Reports for consideration under Section 3.2 of the Listing Policy (LOEs 32688, 46784, 44731, 44594, 32690, and 46783), and one LOE is available in the administrative record from the 2006 Integrated Report for consideration under Section 3.3 of the Listing Policy (LOE 345). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against adding this water segment-pollutant combination to the Section 303(d) list (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus, fecal coliform, and total coliform samples do not exceed the objectives more than the allowable frequency identified in Sections 3.2 (2006 data) and 3.3 (2010 and 2012 data) of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
