| Regional Board Conclusion: | Fecal indicator bacteria (which includes enterococcus and fecal coliform) are being considered for placement on the Section 303(d) list under Section 3.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess indicator bacteria: one for enterococcus and one for fecal coliform.
It should be noted that an additional LOE for total coliform data was not utilized in this decision because these bacteria are widespread in nature and occur in non-fecal sources such as soil and submerged wood. Data assessed for the 2010 Integrated Report include ocean beach bacteria data collected by the Mendocino County Environmental Health Division in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 3.3 of the Listing Policy, a 4% exceedance rate shall be used to add waters to the List "if water quality monitoring was conducted April 1 through October 31 only". There must be either 1) at least 15 samples available for evaluation in order to make a listing determination or 2) 2 or more exceedances from less than 15 samples in which case listing can occur. In this instance, only three samples are available to evaluate each pollutant and there are no exceedances of the evaluation guidelines. Therefore there is not enough data available to make a listing determination for this water body. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against adding this water segment-pollutant combination to the Section 303(d) list (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) None of the 3 enterococcus or 3 fecal coliform samples exceed the water quality objectives, however this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met per Section 3.3 of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
