Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for dieldrin in fish tissue is 0.32 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.

Data Used to Assess Water Quality: Zero of 1 total mercury samples of fish from Copco I Reservoir exceed the evaluation guideline. Sample was comprised of 3 composites that were collected on the same date. Composite concentrations range from 0.175 mg/kg to 0.184 mg/kg. Sample composites were made from fish of each species of approximately the same size. For Copco Lake, 3 sample composites were made as follows: 3 yellow perch that range in fork length size from 188 mm to 197 mm, 5 yellow perch from 168 mm to 172 mm; and 5 yellow perch from 141 mm to 152 mm. Sample composites were analyzed for total mercury with the assumption that 100% of the total mercury value represents the methylmercury content of tissue. Data is summarized by the California Department of Water Resources (DWR 2001; DWR 2007). This LOE re-assesses data from LOE 21169 from the 2010 Integrated Report in order to update the evaluation guideline and average the data collected on the same date/location.

Data Used to Assess Water Quality: None of 3 total mercury composite samples of fish from Copco I Reservoir exceed the evaluation guideline. Sample composite concentrations range from 0.175 mg/kg to 0.184 mg/kg. Sample composites were made from fish of each species of approximately the same size. For Copco Lake, 3 sample composites were made as follows: 3 yellow perch that range in fork length size from 188 mm to 197 mm, 5 yellow perch from 168 mm to 172 mm; and 5 yellow perch from 141 mm to 152 mm. Sample composites were analyzed for total mercury with the assumption that 100% of the total mercury value represents the methylmercury content of tissue. Data is summarized by the California Department of Water Resources (DWR 2001; DWR 2007). This LOE re-assesses data from LOE 21169 from the 2010 Integrated Report in order to update the evaluation guideline.

Data Used to Assess Water Quality: One of one sample exceeded the evaluation guideline. Data were reported on a dry weight basis and were converted to wet weight by multiplying the dry-weight concentration by a factor of 1 minimum the percentage of moisture content expressed as a decimal (78% moisture content = .78). Two composite samples were collected from one site in Copco Reservoir on the same day, and thus, the average of the two composite samples was calculated, per USEPA 2001, resulting in a sample value of .446 mg/kg. Mercury concentrations are assumed to be 100% methylmercury.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.20 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 grams/day was utilized to develop the above criterion, as it is considered to be protective of recent human health recommendations to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.1 of the Listing Policy. Under section 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not delist).

There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Four of 13 water column microcystin toxin samples and 21 of 22 fish tissue microcystin toxin samples exceed their respective evaluation guidelines, and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. (4) The Klamath River TMDL has been approved by the North Coast Regional Water Quality Control Board in March 2010 and approved by USEPA on December 28, 2010. (5) Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Data Used to Assess Water Quality: Twenty-one out of the 22 microcystin samples analyzed from the tissue of perch collected from Copco I Reservoir exceed the evaluation guideline. Sample concentrations range from 0.00 to 473.39 ng/g. Nineteen of the tissue samples were collected from perch fillet, and 3 were collected from perch liver. Fish samples were collected by the California Department of Fish and Game (CDFG) and analyzed for microcystin by the CDFG Fish and Wildlife Water Pollution Control Laboratory in Rancho Cordova, CA. Data are summarized by Kann (2008). The presence of the toxin microcystin in fish and mussels in the Klamath River has the potential to impair the Native American Culture (CUL) and Subsistence Fishing (FISH) beneficial uses, as well as the Commercial and Sport Fishing (COMM) beneficial use listed above.

This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of twelve samples exceed the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available to assess protection of the cold freshwater habitat (COLD) beneficial use, one line of evidence is available to assess protection of the warm freshwater habitat (WARM) beneficial use, and two lines of evidence are available to assess protection of the commercial and sport fishing (COMM) beneficial use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of one fish tissue sample exceeds the evaluation guideline used to assess both the COLD and WARM beneficial uses. Zero of two fish tissue samples exceed the COMM evaluation guideline. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.

This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.
