| Regional Board Conclusion: | No new data were assessed. The pollutant name has been changed from nutrients to nitrate.
This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Staff cannot produce the original information and or data used to place this water segment pollutant combination in the Section 303(d) list. In addition, Six LOEs for Soquel Creek (upstream of the lagoon) do not show any evidence of impairments. More specifically, CCAMP data collected between 5/1/2001 and 12/1/2004 (at the Rail Road Trestle located at the lower end of the creek and when the sand bar prevents flow to the ocean within the lagoon) there is no evidence of elevated nutrients. CCAMP data was collected monthly during the above mentioned time period at this site and resulted in 32 samples. Nitrate levels ranged between less than the detection level of the method and 0.586 mg/L as N. Orthophosphate levels ranged between 0.18 and 0.056 mg/L as P. Based on the lack of available data and information for, there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.
