Regional Board Conclusion: | This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.
Nine lines of evidence are available in the administrative record to assess this pollutant. One hundred fifty one of 794 samples exceeded the geometric mean standard for enterococcus (LOEs 3446, 19301, 19305, 19273, and 56062) and 149 of 1177 samples exceeded the single sample maximum for enterococcus (LOEs 3446, 19302, 19306, 19274, and 56061) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005). The counts above include data summarized in LOE 3446 which describes two separate measurements for enterococcus (86 of 415 samples exceeded the geometric mean standard for enterococcus and 78 of 556 samples exceeded the single sample maximum for enterococcus) for the water contact recreation water quality standard. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One hundred fifty one of 794 samples exceeded the geometric mean standard for enterococcus and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

It should be noted that the data collected between 2007 and 2010 are E. coli results that are evaluated using the Ocean Plan Objective for Fecal Coliform. This objective is higher than the USEPA recreation criteria for E. coli. Evaluation of the data using the Fecal Coliform Objective could result in an erroneous decision to remove the beach segment from the 303(d) List and are not used here as the basis of a decision to de-list. Nine lines of evidence are available in the administrative record to assess this pollutant. Ninety nine of 1017 samples exceeded the geometric mean standard for fecal coliform (LOEs 3446, 19271, 19299, 56064 and 56065) and 92 of 1175 samples exceeded the single sample maximum for fecal coliform (LOEs 3446, 19272, 19300, 19304, and 56063) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005). The counts above include data summarized in LOE 3446 which describes two separate measurements for fecal coliform (55 of 422 samples exceeded the geometric mean standard for fecal coliform and 51 of 558 samples exceeded the single sample maximum for fecal coliform) for the water contact recreation water quality standard. Note that the 86 of 415 sample exceedances listed for LOE 3446 refers to the geometric mean standard for enterococcus and was not included in the calculated totals for fecal coliform (however, this number was included in the sample totals for the enterococcus, Decision ID 41513). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Although 99 of 1017 samples exceeded the geometric mean standard for fecal coliform (LOEs 3446, 19271, 19299, 56064 and 56065) and 92 of 1175 samples exceeded the single sample maximum for fecal coliform and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy, some of these data are for E. coli and are incorrectly compared to the Fecal Coliform Objective. Therefore the decision must remain Do Not De-List. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

This pollutant is being considered for placement on the section 303(d) list under sections 3.2 and 3.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 26 samples is needed to determine if a beneficial use is supported using table 3.2. Therefore, the use support rating is set to 'insufficient information'. Two lines of evidence are available in the administrative record to assess this pollutant.
