Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.

Eight lines of evidence are available in the administrative record to assess this pollutant. One hundred three of 304 samples (LOEs 25355 and 56168) exceeded the shellfish harvesting water quality objective (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2009).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. One hundred three of 304 samples (LOEs 25355 and 56168) exceeded the shellfish harvesting water quality objective and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under sections 3.2 and 3.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.

The pollutant name has been changed to ¿Enterococcus¿ from previous assessments in which the generic ¿Indicator Bacteria¿ pollutant name was used. In the 2010 assessment cycle decision # 5893 resulted in removing this water body from the 303(d) list because the number of exceedances did not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. This current decision summarizes all the data from decision from #5893 in addition to new data from the current listing cycle.

The sample size for the geometric mean for dry weather enterococcus sampling (LOE 31445) is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 22 samples is needed to determine if a beneficial use is supported using the AB411 binomial table specific to listing coastal beaches (www.waterboards.ca.gov/water_issues/programs/tmdl/docs/303d_binomial_tables.xls). Therefore, the use support rating is set to 'insufficient information'.

Seven lines of evidence are available in the administrative record to assess this pollutant. LOE 3504 (for Indicator Bacteria) describes two separate measurements for enterococcus where 72 of 339 samples exceeded the geometric mean standard for enterococcus and 39 of 358 samples exceeded the single sample maximum for enterococcus for the water contact recreation water quality standard. When added to the other LOEs, a total of 81 of 510 samples exceeded the geometric mean standard for enterococcus (LOEs 3504, 19190, and 56155) and 61 of 662 samples exceeded the single sample maximum for enterococcus (LOEs 3504, 19212, and 56154) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005).

This water body segment is identified as an AB411 beach so data collected during the time frame of April 1st to October 31st (dry weather) was also assessed using a four percent exceedance percentage (section 3.3 of Listing Policy). There are two lines of evidence for dry weather single sample and geometric mean calculations. Three of 92 samples exceeded the single sample maximum for enterococcus (LOE 31444) and zero of 19 samples exceeded the geometric mean for enterococcus (LOE 31445).

Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification for adding this water segment-pollutant combination to the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Eighty one of 510 samples exceeded the geometric mean standard for enterococcus (LOEs 3504, 19190, and 56155), 61 of 662 samples exceeded the single sample maximum for enterococcus (LOEs 3504, 19212, and 56154) for the water contact recreation water quality standard and neither of these exceed the allowable frequency listed in Table 3.2 and of the Listing Policy.
4. Three of 92 samples exceeded the single sample maximum for enterococcus (LOE 31444) and 0 of 19 samples exceeded the geometric mean for enterococcus (LOE 31445) collected during the time frame of April 1st to October 31st (dry weather) assessment and neither of these exceed the four percent exceedance percentage criteria described in section 3.3 of the Listing Policy for the water contact recreation water quality objective.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
