Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status. It should be noted that the data collected between 2007 and 2010 are E. coli results that are evaluated using the Ocean Plan Objective for Fecal Coliform. This objective is higher than the USEPA recreation criteria for E. coli. Evaluation of the data using the Fecal Coliform Objective could result in an erroneous decision to remove the beach segment from the 303(d) List and are not used here as the basis of a decision to de-list. Five lines of evidence are available in the administrative record to assess this pollutant. Zero of 165 samples exceeded the geometric mean standard for fecal coliform (LOEs 19324 and 56088) and 9 of 299 samples exceeded the single sample maximum for fecal coliform (LOEs 19363 and 56087) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005). The data associated with the original listing (LOE 3979 - placeholder reference for assessments made prior to the 2006) is no longer available. However, the most recent six years of data show that the beneficial use is being fully supported. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3.Although zero of 165 samples exceeded the geometric mean standard for fecal coliform (LOEs 19324 and 56088) and 9 of 299 samples exceeded the single sample maximum for fecal coliform (LOEs 19363 and 56087) for the water contact recreation water quality standard and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy, some of these data are for E. coli and are incorrectly compared to the Fecal Coliform Objective. Therefore the decision must remain Do Not De-List.. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) List because applicable water quality standards for the pollutant are not used in this assessment. Some of the data included here are E. coli data and those data should not be assessed using the Fecal Coliform Objective

Data were reported on a dry weight basis and were converted to a wet weight basis by multiplying the dry-weight concentration by a factor of 1 minus the percentage of moisture content expressed as a decimal. Ten percent of the total arsenic result was used to estimate of the amount of inorganic arsenic in the sample; this number was screened against the guideline.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.2 and 3.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status. The sample size for the geometric mean for dry weather enterococcus sampling (LOE 31450) is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 22 samples is needed to determine if a beneficial use is supported using the AB411 binomial table specific to listing coastal beaches (www.waterboards.ca.gov/water_issues/programs/tmdl/docs/303d_binomial_tables.xls). Therefore, the use support rating is set to 'insufficient information'. Six lines of evidence are available in the administrative record to assess this pollutant. Thirteen of 165 samples exceeded the geometric mean standard for enterococcus (LOEs 19364 and 56086) and 25 of 300 samples exceeded the single sample maximum for enterococcus (LOEs 19365 and 56085) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005). This water body segment is identified as an AB411 beach so data collected during the time frame of April 1st to October 31st (dry weather) was also assessed using a four percent exceedance percentage (section 3.3 of Listing Policy). There are two lines of evidence for dry weather single sample and geometric mean calculations. One of 19 samples exceeded the geometric mean standard for enterococcus (LOE 31450) and 7 of 90 samples exceeded the single sample maximum for enterococcus (LOE 31451). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One of 19 samples exceeded the geometric mean standard for enterococcus for dry weather sampling (April 1 - October 31, LOE 31450) and 7 of 90 samples exceeded the single sample maximum for enterococcus for dry weather sampling (April 1 - October 31, LOE 31451), neither of these exceed the four percent exceedance percentage criteria described in section 3.3 of the Listing Policy for the water contact recreation water quality objective. 4.
