Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under section 4.2 a single line of evidence is necessary to assess listing status. Fourteen (14) lines of evidence are available in the administrative record to assess this pollutant. Zero (0) of 0 samples exceed the E. coli Geomean Objective. Twenty five (25) of 84 samples exceed the E. coli Single Sample Objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero (0) of the 0 samples exceed the E. coli Geomean Objective, and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 5 samples is needed to determine if a beneficial use is fully supported using Table 4.2. 4. Twenty five (25) of the 84 samples exceed the E. coli Single Sample Objective, and this does exceed the frequency listed in table 4.2. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. 303(d) listing decisions made prior to 2006 were not held in an assessment database. The Regional Boards will update this decision when new data and information become available and are assessed.

Sd5 - Irvine Civic Center: This site is located behind the Irvine Civic center on Alton Drive in Irvine. The Civic Center site SD5 usually hosts a wide variety of bird life from mallard ducks to great Herons.

Sd6 - Michelson: The Michelson site is located off of the 405 freeway and Jamboree west, to Michelson south, and then west on Riparian Way. The site is located down the dirt road just past the bridge.

Regional Board Conclusion:	Benthic Community Effects is being considered for placement on the CWA section 303(d) List under sections 3.9 and 3.1 of the Listing Policy. Under section 3.9, an additional line of evidence associating Benthic Community Effects with a water or sediment concentration of pollutant(s) is necessary to assess listing status. Ten lines of evidence are available. Ten of the 10 benthic invertebrate samples exceed (fall below) the Southern California IBI threshold for poor community composition. This water segment is also on the CWA section 303(d) List for nutrients, selenium, sedimentation/siltation, toxaphene, malathion and toxicity to invertebrate test organisms in water and sediment samples. Based on the readily available data and information, the weight of evidence provides sufficient justification for placing Benthic Community Effects in this water segment on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Pursuant to section 3.9 of the Listing Policy, the water segment exhibits significant degradation in biological populations and/or communities as compared to reference site(s) using the SoCal IBI. 4. Pursuant to section 3.9 of the Listing Policy, the water segment has associated pollutant(s) samples that exceed water quality objectives. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are being met. Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.6 of the Listing Policy. Under section 3.6 at least one line of evidence is necessary to assess listing status for toxicity, and waters may be placed on the CWA section 303(d) List for toxicity alone. Three lines of evidence are available in the administrative record to assess this pollutant. Five of the 25 samples exhibited sediment toxicity. Twenty-one of the 53 samples exhibited water toxicity. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of the 25 samples exhibited sediment toxicity and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. Twenty-one of the 53 samples exhibited water toxicity and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Under section 3.1, a single line of evidence are necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Zero (0) of the one (1) sediment sample exceeds the PEC for total DDTs. Zero of the 1 sediment sample exceeds the PEC for sum of DDT. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero (0) of the one (1) sediment sample exceeds the PEC for total DDTs. Zero of the 1 sediment sample exceeds the PEC for sum of DDT and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. 4. Pursuant to section 3.11 of the Listing Policy, additional data and information are available indicating that standards are not met. Therefore, the previous conclusion remains unchanged; however, a TMDL has been developed and approved by USEPA and the approved implementation plan is expected to result in full attainment of the standard within a specified time frame. The previous conclusion is as follows: This pollutant is being considered for placement on the section 303(d) list under section 3.5 of the Listing Policy. Under section 3.5 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. A sufficient number of samples exceed the NAS Guideline for the protection of aquatic life from bioaccumulation of toxic substances. Under section 3.5 of the Listing Policy any water body segment where tissue pollutant levels in organisms exceed a pollutant-specific evaluation guideline shall be placed on the section 303(d) list.
