Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Two of the fifteen water samples collected in 2005 had calculated 4-day average chlorpyrifos concentrations that exceeded the 4-day average chlorpyrifos criterion of 0.015 ug/L, and one of the 15 water samples had calculated 1-hour average chlorpyrifos concentrations that exceeded the 1-hour average chlorpyrifos criterion of 0.025 ug/L. These exceedances triggered the Irrigated Lands Regulatory Program to require a management plan for chlorpyrifos. In 2010, the executive officer of the Central Valley Water Board determined that the Management Plan was completed and that further actions identified in the Plan are not required. The determination that the Plan has been completed is based on the following: 1) No exceedances (or detections) of chlorpyrifos have been observed in samples taken during all thirteen monitoring events at the Striplin Road site since October 2005; 2) Growers applying chlorpyrifos in the drainage were notified of the exceedances detected in July and September 2005; 3) Further outreach was performed by CURES at Coalition meetings. The determination also stated "While the Coalition¿s Source Evaluation shows that agricultural activities were a likely source of these exceedances, the series of monitoring events with no chlorpyrifos exceedances indicates that water quality objectives are being met for this chemical in the Coon Creek drainage. The Coalition will continue to monitor for chlorpyrifos in this drainage as a part of the regular Monitoring and Reporting Program in assessment years." None of five monthly water samples collected in 2009 had average chlorpyrifos concentrations that exceed the 4-day average (chronic) chlorpyrifos criterion of 0.015 ug/L. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of 15 water samples collected in 2005 exceeded the evaluation guideline for chlorpyrifos, and this exceeded the allowable frequency listed in Table 4.1 of the Listing Policy. The exceedances triggered the Irrigated Lands Regulatory Program to require the Sacramento Valley Water Quality Coalition to create, implement and complete a Management Plan for chlorpyrifos in the Coon Creek subwatershed. 4. None of five monthly water samples collected in 2009 had average chlorpyrifos concentrations that exceed the 4-day average (chronic) chlorpyrifos criterion of 0.015 ug/L. 5. In 2010, the executive officer of the Central Valley Water Board determined that the Management Plan was completed and that further actions identified in the Plan are not required. 6. A total of eleven Considered together, nine of 17 water sample results exceed the evaluation guideline for the Water Contact Recreation beneficial use. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category. Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant. One of the twenty-nine samples exceed the criteria. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3.
