Regional Board Conclusion: | This water body segment and pollutant combination was reconsidered for placement on the 303(d) list under section 3.1 of the Listing Policy. Under section 3.1, a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. The evidence indicates that chlorpyrifos concentrations have not been exceeding the applicable water quality standards and that the original listing decision was based on a flawed interpretation of sample results.
In the original listing, four of ten sample results were considered to be exceeding the chronic water quality criterion; however, three of these four exceedances were from samples with results below the quantitation limit and therefore should not have been included in the analysis under section 6.1.5.5 of the Listing Policy. Based on the readily available data and information, the weight of evidence indicates this water segment-pollutant combination was originally assessed incorrectly and placed on the section 303(d) list in error. The correct sample and exceedances counts do not exceed the applicable water quality standards. Since this waterbody and pollutant combination was originally placed on the 303(d) list in error, this new (2014 Integrated Report cycle) decision is to remove it from the 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Ten water samples were collected from Ash Slough in 2005 and 2006, representing seven calculated 4-day concentrations and seven 1-hour concentrations.
