Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. Two of the three daily minimum dissolved oxygen measurements do not meet the the water quality objective of 5.0 mg/L. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of three daily minimum dissolved oxygen measurements samples do not meet the water quality objective, and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. According to the Listing policy and Table 3.2, a minimum of five samples is required to list a water body for conventional pollutants, including dissolved oxygen. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

Within the legal boundaries of the Delta, the dissolved oxygen concentration shall not be reduced below:
7.0 mg/l in the Sacramento River (below the I Street Bridge) and in all Delta waters west of the Antioch Bridge; 6.0 mg/l in the San Joaquin River (between Turner Cut and Stockton, 1 September through 30 November); and 5.0 mg/l in all other Delta waters except for those bodies of water which are constructed for special purposes and from which fish have been excluded or where the fishery is not important as a beneficial use. The objective of 5.0 mg/l applies to Fourteenmile Slough and the Village West Marina in the eastern Delta.

"Village West Marina" denotes the study region, the first number denotes the station number, and the second number denotes the sampling event number.
The four sampling stations are close enough to be considered the same location per section 6.1.5.2 of the Listing Policy. Further, the California Department of Pesticide Regulation (DPR) report that describes the monitoring design states, ¿The four samples taken inside each marina and the four samples taken for each LRS area during each sampling event represented sub-samples for that particular marina and LRS area.¿ (DPR, 2009, page 15) This provides additional justification for considering the four Village West Marina stations to be considered the same location. As a result, staff assessed the Village West Marina data collected during each sampling event as one location.

Evaluation Guideline:

California Toxics Rule (CTR) lists criterion continuous concentrations to protect aquatic life in freshwater. The criterion in freshwater is hardness dependent for each sample and varies based on the ambient hardness during sampling. Section (b)(1) in CTR contains the hardness dependent formula for the metals criterion. If no hardness data were available, a hardness of 100 mg/L was used.
