Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list. Under section 4.5 and 4.6 of the Listing Policy a single line of evidence is necessary to assess listing status.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of nine samples exceeded the the OEHHA screening value for DDT in fish tissue and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met. A minimum of 28 samples is needed for application of table 4.1.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Spatial Representation: A total of eight grab samples were collected during each sampling event from Marina del Rey Front and Back Basin (sites 1, 2, 3, & 4). Sample results from the front basins and the back basins were averaged separately per sample event for a total of two sample results per event.
Temporal Representation: Samples were collected on three separate sampling events during the dry season (July - October) in 2006.
Environmental Conditions: Samples were collected during the dry season only.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 6 of 7 and 7 of 8 samples exceeded the BPTCP reference envelope evaluation guideline and one of four samples exhibited significant toxicity to Eohaustorius Estuarius. However, a TMDL has been development and approved by USEPA. Implementation of the TMDL is anticipated to address sediment toxicity in this water body.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for removal from the 303(d) List under section 4.5 and 4.6 of the Listing Policy.

Five lines of evidence are available in the administrative record to assess this pollutant. Two of 4 samples exceed the OEHHA screening value. However, a TMDL is in place to address this pollutant in this water body.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

This conclusion is based on the staff findings that:
1. The sediment quality guideline used complies with the requirements of section 6.1.3 of the Policy.
2. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
3. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
4. Three out of 4 samples exceeded the OEHHA Screening Value for fish tissue and, although none of the 18 sediment samples exceeded the criteria for PCBs, 6 samples were found to be toxic. However, a TMDL is in place to address this pollutant in this water body. The Marina Del Rey Toxics TMDL was approved by the RWQCB in October of 2005 and subsequently approved by USEPA.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: This is a decision previously approved by the State Water Resources Control Board and the USEPA. No new data were assessed by the Regional Board for the current cycle. The decision has not changed.
