Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.
Fourteen lines of evidence are available in the administrative record to assess the pollutant.

LOEs 22562 and 95486 are replaced with LOE 227109. LOEs 22561 and 95485 are replaced with LOEs 227373, 227365 and 227237. LOEs 22575 and 95514 are replaced with LOE 227504. The replacement LOEs are reassessments of the same data following the statewide mercury objectives adopted in 2017.
WILD beneficial use (prey fish objective):
LOEs 227454, 227359: 2 of 2 samples exceed the mercury objective and consist of a combined total of 30 fish that can be a mixture of trophic levels collected between February and July of the same calendar year.
WILD beneficial use (sport fish objective):
LOE 227309: 1 of 1 samples exceed the mercury objective and consist of 3 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227452: 1 of 1 samples exceed the mercury objective and consist of 6 trophic level 3 fish.
LOE 227562: 1 of 1 samples exceed the mercury objective and consist of 5 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227066: 1 of 1 samples exceed the mercury objective and consist of 3 trophic level 4 fish.
LOE 227081: 1 of 1 samples exceed the mercury objective and consist of 9 trophic level 4 fish. Fish lengths are within CDFW length limits.
LOE 227371: 1 of 1 samples exceed the mercury objective and consist of 15 trophic level 4 fish. Fish lengths are within CDFW length limits.
LOE 227566: 1 of 1 samples exceed the mercury objective and consist of 5 trophic level 4 fish.

COMM beneficial use (sport fish objective):
LOE 227373: 1 of 1 samples exceed the mercury objective and consist of 3 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227365: 1 of 1 samples exceed the mercury objective and consist of 6 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227504: 1 of 1 samples exceed the mercury objective and consist of 5 trophic level 3 fish. Fish lengths are within CDFW length limits.
LOE 227109: 1 of 1 samples exceed the mercury objective and consist of 9 trophic level 4 fish. Fish lengths are within CDFW length limits.
LOE 227237: 1 of 1 samples exceed the mercury objective and consist of 15 trophic level 4 fish. Fish lengths are within CDFW length limits.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Tissue samples were compared with the prey fish objective and 2 of 2 samples exceed WILD beneficial use. The sample, which may contain a mix of trophic levels, is aggregated from less than eight fish and were collected during the same year. The sample does not meet the one exceeding sample of eight or more fish needed to determine non-attainment of the mercury objective following weight of evidence in Listing Policy section 3.11.

Tissue samples were compared with the sport fish objective and 3 of 3 samples exceed for WILD beneficial use and 3 of 3 samples exceed for the COMM beneficial use. The samples consist of trophic level 3 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
Tissue samples were compared with the sport fish objective and 4 of 4 samples exceed for WILD beneficial use and 2 of 2 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
A minimum of 3 annual averages based on composite fish tissue samples must meet the standard to indicate attainment of the standard.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: This decision was made by SWRCB staff.

State Board Review of Regional Board Conclusion and Recommendation: Tissue samples were compared with the sport fish objective and 3 of 3 samples exceed for WILD beneficial use and 3 of 3 samples exceed for the COMM beneficial use.

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.

DECISION ID
121731
Region 5
Indian Valley Reservoir (Lake County)

Pollutant: pH
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the Clean Water Act (CWA) section 303(d) List under section 3.2 of the Listing Policy.

A total of 15 lines of evidence are available in the administrative record to assess this pollutant. A total of zero of 19 samples exceed the water quality objective for the cold freshwater habitat beneficial use, zero of 19 samples exceed the water quality objective for the non-contact recreation beneficial use and zero of 19 samples exceed the water quality objective for the water contact recreation beneficial use. These data are insufficient to determine the applicable beneficial use support rating with the power and confidence required by the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. This does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

DECISION ID
121730
Region 5
Indian Valley Reservoir (Lake County)

Pollutant: Oxygen, Dissolved
Final Listing Decision: List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Sources: A Source Unknown
Expected TMDL Completion Date: 2035
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the Clean Water Act (CWA) section 303(d) List under section 3.2 of the Listing Policy.

A total of 10 lines of evidence are available in the administrative record to assess this pollutant. A total of nine of 18 samples exceed the water quality objective for the cold freshwater habitat beneficial use and nine of 19 samples exceed the water quality objective for the fish spawning beneficial use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. A total of nine of 18 samples exceed the water quality objective for the cold freshwater habitat beneficial use and nine of 19 samples exceed the water quality objective for the fish spawning beneficial use. This exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.
