Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List. 5 lines of evidence are available in the administrative record to assess the pollutant. LOE 65510 is replaced with LOE 225940. LOE 225940 is a reassessment of the same data following the statewide mercury objectives adopted in 2017. WARM freshwater habitat: LOE 197620: 0 of 14 samples exceed the water quality objective for the dissolved fraction of mercury in the water matrix. WILD beneficial use (sport fish objective): LOE 225956: 1 of 1 samples exceed the mercury objective and consist of 20 trophic level 4 fish. COMM beneficial use: LOE 225940: 1 of 1 samples exceed the sport fish tissue objective and consist of 5 trophic level 4 fish. Fish lengths are within CDFW length limits. LOE 197619: 2 of 2 samples exceed the water quality objective for the dissolved fraction of mercury in the water matrix. LOE 735: A placeholder LOE to support a 303(d) listing decision made prior to 2006. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Tissue samples were compared with the sport fish objective and 1 of 1 samples exceed for the WILD beneficial use, and these samples consist of trophic level 4 fish that are annual averages and are aggregated from at least eight fish and this meets the one exceeding sample of eight or more fish needed to determine non-attainment of the mercury objective following weight of evidence in Listing Policy section 3.11. Tissue samples were compared with the sport fish objective and 1 of 1 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish that are annual averages and are aggregated from less than eight fish. The sample does not meet the one exceeding sample of eight or more fish needed to determine non-attainment of the mercury objective following weight of evidence in Listing Policy section 3.11. However, for the COMM beneficial use, 2 of 2 samples exceed water quality objective for the dissolved fraction of mercury in the water matrix. This exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

Impairment from Pollutant or Pollution: | Pollution |
Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Zero samples exceeded the objectives, guidelines, or criteria for beneficial uses applicable to this water segment-pollutant combination, which is less than the minimum number of exceedances needed to place the water segment on the section CWA section 303(d) List for toxicants (Table 3.1 of the Listing Policy). The data used satisfies the data quality requirements (section 6.1.4) and data quantity requirements (section 6.1.5) of the Listing Policy. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. 2 of the 37 samples exceed the objective for Warm Freshwater Habitat. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 2 of the 37 samples exceed the objective for Warm Freshwater Habitat. and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for placement on the Clean Water Act (CWA) section 303(d) List under section 3.1 of the Listing Policy. A total of one line of evidence is available in the administrative record to assess this pollutant. A total of zero of 13 samples exceed the water quality objective for the warm freshwater habitat beneficial use. These data are insufficient to determine the applicable beneficial use support rating with the power and confidence required by the Listing Policy. 3. A total of zero of 13 samples exceed the water quality objective for the warm freshwater habitat beneficial use. This does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant. 3. Two of the 18 samples exceeded the OBJECTIVE for Warm Freshwater Habitat. Four of the 24 samples exceeded the OBJECTIVE for REC-1 and REC-2. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 26 samples is needed to determine if a beneficial use is fully supported using table 3.2. 4. Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. Five of the 18 samples exceed the Warm Freshwater Habitat threshold. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of the 18 samples exceed the Warm Freshwater Habitat threshold and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem. |

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.
One line of evidence is available in the administrative record to assess this pollutant. Zero of the one samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of one samples exceeded the evaluation guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of sixteen samples is needed to determine if a beneficial use is fully supported using table 3.1. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. |

Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. One of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM. 3. One of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Zero of one sample exceeds the evaluation guideline for WARM and zero of one sample exceeds the evaluation guideline for COMM. 3. Zero of one sample exceeds the evaluation guideline for WARM and zero of one sample exceeds the evaluation guideline for COMM. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Zero of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM. 3. Zero of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |

Impairment from Pollutant or Pollution: | Pollutant |
Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.
Two lines of evidence are available in the administrative record to assess this pollutant. Zero of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM. 3. Zero of one samples exceed the water quality objective for COMM, and zero of one samples exceed the water quality objective for WARM and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. |
