Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.
Four lines of evidence (LOE) are available in the administrative record to assess this pollutant. Data from Pumping Plant D, which receives its water from Tule Lake, reflect zero of 16 samples exceeding the evaluation guideline for the protectino of COLD and MUN. Data from the Klamath Straits Drain at Stateline reflect zero of 16 samples exceed the evaluation guideline for the protetion of MUN. Data from the Klamath Straits Drain at Stateline reflect five of 16 samples exceed the evaluation guideline for the protection of COLD. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of four samples exceed the objective for the MUN beneficial use at Pumping Plant-D. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) There are only 24 grab samples from the Lost River (LOE 32606), 16 grab samples from Pumping Plant D (LOE 32608), and 16 grab samples from the Klamath Straits drain (LOE 32609) and no exceedances of the evaluation guideline used to interpret the narrative temperature objective. However, these sample sizes are not sufficient to determine with the power and confidence of the Listing Policy if the cold freshwater habitat (COLD) beneficial use is being protected in these water bodies, as a minimum of either (A) 26 samples, or (B) greater than or equal 5 exceedances of the COLD criteria with less than 26 samples is needed for application of Table 3.2. (4) Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
