Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant for Cold Freshwater Habitat (COLD) and Municipal and Domestic Supply (MUN). One of the 17 samples, reported as a dissolved concentration, exceed the guideline for COLD. Zero of the 17 samples, reported as a dissolved concentration, exceed the objective for MUN. The Basin Plan establishes an appropriate method for assessing data according to secondary MCLs, which includes evaluating whole water concentrations after a sample is filtered. Water Quality for Agriculture, published by the Food and Agriculture Organization of the United Nations in 1985, contains criteria protective of various agricultural uses of water, including irrigation of various types of crops and stock watering. At or below the limits presented in the Water Quality Goals tables, agricultural uses of water should not be limited. These criteria were used to translate narrative water quality objectives for chemical constituents that prohibit chemicals in concentrations that would impair agricultural uses of water. Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Eleven lines of evidence are available in the administrative record to assess this pollutant. Two of the 45 samples exceed the criteria for Aquatic Life; zero of two samples exceeded the criteria for Municipal and Domestic Supply; one of the 19 samples exceeded the criteria for Non-contact Recreation; and one of the 21 samples exceed the criteria for Water Contact Recreation. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. None of the samples exceed the water quality objective. None of ten samples exhibited significant toxicity to Ceriodapnia dubia (water flea an invertebrate species), Pimepheles promelas (fathead minnow, a vertebrate species), or Selenastrum capricornutum (an algal species). Under section 3.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Zero of 2 samples exceed the California Toxics Rule (2000) criterion for COLD, and 0 of 2 samples exceed the California Toxics Rule (2000) criterion for MUN. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of 2 samples exceed the California Toxics Rule (2000) criterion for COLD, and 0 of 2 samples exceed the California Toxics Rule (2000) criterion for MUN and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is fully supported using table 3.1. 4. Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.
