Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

LOE 223650: 1 of 1 samples exceed the mercury objective and consist of 40 prey fish sampled from a mixture of trophic levels and collected during the calendar year.
LOE 227095: 1 of 1 samples exceed the mercury objective and consist of 5 prey fish sampled from a mixture of trophic levels and collected during the calendar year.

WILD beneficial use (sport fish objective):
LOE 223680: 1 of 1 samples exceed the mercury objective and consist of 7 trophic level 4 fish. Fish lengths are within CDFW length limits.
LOE 227129: 1 of 1 samples exceed the mercury objective and consist of 3 trophic level 4 fish. Fish lengths are within CDFW length limits.

COMM beneficial use (sport fish objective):
LOE 223667: 1 of 1 samples exceed the mercury objective and consist of 7 trophic level 4 fish. Fish lengths are within CDFW length limits.
LOE 227090: 1 of 1 samples exceed the mercury objective and consist of 3 trophic level 4 fish. Fish lengths are within CDFW length limits.

COMM beneficial use (total mercury objective):
LOE 22102: 0 of 13 samples exceed the total mercury water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Tissue samples were compared with the sport fish objective and 2 of 2 samples exceed for WILD beneficial use and 2 of 2 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. In addition, tissue samples were compared with the prey fish objective and 2 of 2 samples exceed for WILD beneficial use. Samples may consist of a mix of trophic levels and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. A minimum of 3 annual averages based on composite fish tissue samples must meet the standard to indicate attainment of the standard.

4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Quality control for sample collection, preparation, handling, and analyses were conducted in accordance with the Surface Water Ambient Monitoring Program Quality Assurance Program Plan (Puckett, 2002) with the following exception: instead of wrapping fish in Teflon sheets before being frozen and transported to the laboratory, the fish were wrapped in aluminum foil (dull side to skin). This wrapping method should not have affected mercury concentrations. Quality control procedures for selection of target fish species and compositing of samples followed the General Protocol for Sport Fish Sampling and Analysis developed by OEHHA (Gassel and Brodberg, 2005).

The total recoverable mercury concentrations in water ranged from 0.24 ng/l to 0.94 ng/l with an average of 0.58 ng/l for the thirteen 30-day average samples.
