Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant. Two of the 33 samples, in the total concentration, exceed the criterion for the COLD beneficial use. The Basin Plan establishes an appropriate method for assessing data according to secondary MCLs, which includes evaluating whole water concentrations after a sample is filtered. In the absence of results from properly filtered samples, only the dissolved fraction will be used to determine impairment until this method is fully implemented. Whole water concentrations, or data with an unreported fraction, were not considered in this assessment.
