Region 6
Silverwood Lake

Pollutant: Mercury
Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Sources: A Source Unknown
Expected TMDL Completion Date: 2025
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 & 4.5 of the Listing Policy. Under these sections a single line of evidence is necessary to assess listing status.

Three lines of evidence, two which evaluate fish tissue data for the COMM beneficial use and one which evaluates fish tissue data for the WILD beneficial use, are available in the administrative record to assess pollutant. 2 of 2 composite trophic level four fish tissue samples exceed the objective for the COMM beneficial use; 1 of 1 composite 50-150mm prey fish tissue samples exceed the objective for the WILD beneficial use.

LOE 132854 replaces the 2012 LOEs 47544 & 45699 as these LOEs were written using an objective which is now superseded. LOE 132854 uses the same data as the 2012 LOEs and evaluates the information using the newly adopted mercury objective. The 2012 LOEs will be removed from the next iteration of this decision.

In 2013 the Office of Environmental Heath Hazard Assessment (OEHHA) published a health advisory for Silverwood Lake. The advisory provides information regarding which fish should not be eaten because of mercury contamination in the waterbody. For more information please see the OEHHA website.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 2 of 2 composite fish tissue samples exceeded the objective for the COMM beneficial use and 1 of 1 composite prey fish tissue samples exceed the objective for the WILD beneficial use and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.

Data Used to Assess Water Quality: Water Board staff assessed SWAMP data for Silverwood Lake to determine beneficial use support and results are as follows: 1 of 1 samples exceed the criterion for Mercury. Sixteen composites (1 fish per composite) were generated from one species (largemouth bass) and were averaged. One composite sample could not be used in the assessment due to a total fish length that did not fall within lengths noted in the guideline. The results of the composites collected on the same day were averaged, per USEPA 2001, resulting in a total of one sample and one exceedance. Details of the compositing protocol can be found in the March 2009 report entitled: "Contaminants in Fish from California Lakes and Reservoirs: Technical Report on Year One of a Two-Year Screening Study" (SWAMP, 2009).

DECISION ID
76279
Region 6
Silverwood Lake

Pollutant: PCBs (Polychlorinated biphenyls)
Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Sources: A Source Unknown
Expected TMDL Completion Date: 2025
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Five lines of evidence, two which assess the available tissue data for the COLD beneficial use, two which assess the available tissue data for the COMM beneficial use, and one which assesses the available sediment data for the COLD beneficial use, are available in the administrative record to assess this pollutant. 2 of 14 tissue samples exceed the water quality guideline for the COLD beneficial use; 13 of 14 tissue samples exceed the water quality goal for the COMM beneficial use; 0 of 1 sediment samples exceed the guideline for the COLD beneficial use.

Data collected by the SWAMP Bioaccumulation Oversight Group prompted the Office of Environmental Health Hazard Assessment (OEHHA) to issue a fish consumption advisory in August of 2013 for Silverwood Lake based on elevated levels of PCBs.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the following:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 2 of 14 tissue samples exceed the water quality guideline for the COLD beneficial use; 13 of 14 tissue samples exceed the water quality goal for the COMM beneficial use and these datasets exceed the allowable frequency listed in Table 3.1 of the Listing Policy.
4. The Office of Environmental Health Hazard Assessment (OEHHA) has issued a health advisory and guidelines for eating fish from Silverwood Lake due to high levels of mercury and PCBs. Refer to fish tissue info and resources for the Lahontan Region at: https://www.waterboards.ca.gov/lahontan/water_issues/programs/swamp/index.shtml for a summary of the advisory and the background information (including associated sample results) and a description of how the guidelines were developed. Pursuant to section 3.4 of the Listing Policy, "a water segment shall be placed on the section 303(d) list if a health advisory against the consumption of edible resident organisms, has been issued by OEHHA or DHS."

Pollutant: Aldrin
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not List on 303(d) list (TMDL required list)(2016)
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. 0 of 2 samples exceed the water quality guideline.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used does not satisfy the data quantity requirements of section 6.1.5 of the Policy.
3. 0 of 2 samples exceeded the guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples are needed to determine if a beneficial use is fully supported using table 3.1.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. The readily available data and information is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. 0 of 1 samples exceed the evaluation guideline.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 0 of 1 samples exceeded the guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Five lines of evidence, two which assess the available tissue data for the COLD beneficial use, two which assess the available tissue data for the COMM beneficial use and one which assesses the available sediment data for the COLD beneficial use, are available in the administrative record to assess this pollutant. 0 of 2 tissue samples for the COLD beneficial use assessment exceed the water quality guideline; due to quantitation issues, no samples met the quality control standards for tissue data assessed for the COMM beneficial use (0 of 0 samples exceed the guideline); 0 of 1 sediment samples exceed the water quality guideline for the COLD beneficial use assessment.

3. 0 of 2 tissue samples for the COLD beneficial use assessment exceed the water quality guideline; due to quantitation issues, no samples met the quality control standards for tissue data assessed for the COMM beneficial use (0 of 0 samples exceed the guideline); 0 of 1 sediment samples exceed the water quality guideline for the COLD beneficial use assessment, and these sample sizes are insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples per beneficial use assessed are needed to determine if a beneficial use is fully supported using table 3.1.

Data Used to Assess Water Quality: Water Board staff assessed SWAMP data for Silverwood Lake to determine beneficial use support and results are as follows: 0 of 0 samples exceed the criterion for Dieldrin. Two composites (5 fish per composite) were generated from one species: largemouth bass. Details of the compositing protocol can be found in the March 2009 report entitled: "Contaminants in Fish from California Lakes and Reservoirs: Technical Report on Year One of a Two-Year Screening Study" (SWAMP, 2009). The composites were not used in the assessment because the laboratory data reporting limit(s) was above the objective and therefore the results could not be quantified with the level of certainty required by the Listing Policy.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence, one which assesses the available data for the COLD beneficial use and one which assesses the available data for the COMM beneficial use, are available in the administrative record to assess this pollutant. 0 of 1 samples in each beneficial use assessment exceed the evaluation guideline.

2. The data used does not satisfy the data quantity requirements of section 6.1.5 of the Policy.
3. 0 of 1 samples in each beneficial use assessment exceeded the guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples per beneficial use assessed are needed to determine if a beneficial use is fully supported using table 3.1.

For both the tissue assessments (COLD and COMM BU's), 0 of 2 samples exceed the water quality objective; For the sediment assessment, 0 of 1 samples exceed the water quality objective for the COLD beneficial use.

3. For both the tissue assessments (COLD and COMM BU's), 0 of 2 samples exceed the water quality objective; For the sediment assessment, 0 of 1 samples exceed the water quality objective for the COLD beneficial use and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples per beneficial use assessment are needed to determine if a beneficial use is fully supported using table 3.1.

Silverwood Lake

Pollutant: Hexachlorobenzene/ HCB

0 of 2 samples exceed the water quality objective.

Five lines of evidence, two which assess the available tissue data for the COLD beneficial use, two which assess the available tissue data for the COMM beneficial use and one which assesses the available sediment data for the COLD beneficial use, are available in the administrative record to assess this pollutant. 0 of 2 tissue samples exceed the water quality objectives for the COMM beneficial use; 0 of 2 tissue samples exceed the water quality guidelines for the COLD beneficial use; 0 of 1 sediment samples exceed the objective for the COLD beneficial use.

3. 0 of 2 tissue samples exceed the water quality objectives for the COMM beneficial use; 0 of 2 tissue samples exceed the water quality guidelines for the COLD beneficial use; 0 of 1 sediment samples exceed the objective for the COLD beneficial use, and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples per beneficial use assessed are needed to determine if a beneficial use is fully supported using table 3.1.

One line of evidence is available in the administrative record to assess this pollutant. Data evaluated for this assessment did not meet the quality assurance guidelines required of the Listing Policy. 0 of 0 of the samples exceed the water quality objective.

3. 0 of 0 samples exceeded the guideline and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.
