Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Sixteen lines of evidence are available to assess this pollutant for Municipal and Domestic Supply (MUN) and Cold Freshwater Habitat (COLD). Zero of the eight samples, reported as a dissolved concentration, exceed the water quality objective for MUN. The Basin Plan establishes an appropriate method for assessing data according to secondary MCLs, which includes evaluating whole water concentrations after a sample is filtered. In the absence of results from properly filtered samples, only the dissolved fraction will be used to determine impairment until this method is fully implemented. Whole water concentrations, or data with an unreported fraction, were not considered in this assessment. One of the seven samples in the total fraction exceed the evaluation guideline for Cold Freshwater Habitat and zero of the eight samples in the dissolved fraction exceed the evaluation guideline for Cold Freshwater Habitat. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of the eight samples, reported as a dissolved concentration, exceed the water quality objective for MUN. Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

All receiving water samples were grab samples. Concentrations of iron (expressed as total recoverable) ranged from 50 ug/L in June 2002 to 590 ug/L in May 2002. The samples collected in February, May, July, August and December 2002 had total recoverable iron concentrations ranging from 300 to 590 ug/L, which are greater than the DHS secondary MCL of 300 ug/L. Five samples out of 12 receiving water samples contained levels of total recoverable iron that exceeded the MCL (Central Valley RWQCB, 2003a).

The Deer Creek Wastewater Treatment Plant is located in the Section 16, T9N, R9E, MDB&M, adjacent to Deer Creek, a tributary to the Cosumnes River. Receiving water samples were collected at the NPDES permit R1 monitoring location, which is located in Deer Creek at the gauging station upstream of the point of discharge at the first bridge crossing Deer Creek as part of the access road to the DCWWTP.

Regional Board Conclusion:	During 2024 cycle, the 1988 National Recommended Water Quality Criteria used to assess aluminum data was replaced with U.S. EPA’s 2018 Final Recommended Aquatic Life Criteria for Aluminum in Freshwater. Insufficient information is available to determine beneficial use support for this waterbody-pollutant combination with the statistical power and confidence required by the Listing Policy. Beneficial use support will be reassessed in a future cycle, if more data are available.

Under section 3.1 a single line of evidence is necessary to assess listing status. Eight lines of evidence are available in the administrative record to assess this pollutant. Zero of the four samples exceed the criteria for MUN. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. The July 2002 sample had a concentration of 260 ug/l, which is greater than the DHS secondary MCL of 50 ug/l. The other 11 samples had concentrations of manganese less than the DHS secondary MCL.

One sample out of 12 exceeded the DHS Secondary MCL. (CVRWQCB, 2003a).

Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Eight lines of evidence are available in the administrative record to assess this pollutant. Three of 16 samples exceed the objective for COLD. Additionally, 27 of 719 samples exceed the objective for COLD and SPWN but these data were not considered in this assessment because they do not meet the the Quality Assurance Project Plan requirements of the Listing Policy. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Discharges shall not result in pesticide concentrations in bottom sediments or aquatic life that adversely affect beneficial uses.
